---|
7 | 7 | | relating to regulation of on-site sewage disposal systems including |
---|
8 | 8 | | occupational licensure requirements associated with those systems. |
---|
9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
---|
10 | 10 | | SECTION 1. Section 366.002(7), Health and Safety Code, is |
---|
11 | 11 | | amended to read as follows: |
---|
12 | 12 | | (7) "On-site sewage disposal system" means one or more |
---|
13 | 13 | | systems of treatment devices and disposal facilities that: |
---|
14 | 14 | | (A) produce not more than 10,000 [5,000] gallons |
---|
15 | 15 | | of waste each day; and |
---|
16 | 16 | | (B) are used only for disposal of sewage produced |
---|
17 | 17 | | on a site on which any part of the system is located. |
---|
18 | 18 | | SECTION 2. Section 366.0512, Health and Safety Code, is |
---|
19 | 19 | | amended to read as follows: |
---|
20 | 20 | | Sec. 366.0512. MULTIPLE TREATMENT SYSTEMS. A multiple |
---|
21 | 21 | | system of treatment devices and disposal facilities may be |
---|
22 | 22 | | permitted as an on-site disposal system under this chapter if the |
---|
23 | 23 | | system: |
---|
24 | 24 | | (1) is located on a tract of land of at least 100 acres |
---|
25 | 25 | | in size; |
---|
26 | 26 | | (2) produces not more than 10,000 [5,000] gallons a |
---|
27 | 27 | | day on an annual average basis; |
---|
28 | 28 | | (3) is used only on a seasonal or intermittent basis; |
---|
29 | 29 | | and |
---|
30 | 30 | | (4) is used only for disposal of sewage produced on the |
---|
31 | 31 | | tract of land on which any part of the system is located. |
---|
32 | 32 | | SECTION 3. Section 366.052(a), Health and Safety Code, is |
---|
33 | 33 | | amended to read as follows: |
---|
34 | 34 | | (a) Sections 366.051, 366.053, 366.054, and 366.057 do not |
---|
35 | 35 | | apply to an on-site sewage disposal system of a single residence |
---|
36 | 36 | | that is located on a land tract that is 1,000 [10] acres or larger in |
---|
37 | 37 | | which the field line or sewage disposal line is not closer than 100 |
---|
38 | 38 | | feet of the property line. |
---|
39 | 39 | | SECTION 4. Section 366.071(a), Health and Safety Code, is |
---|
40 | 40 | | amended to read as follows: |
---|
41 | 41 | | (a) A person who constructs, installs, alters, extends, |
---|
42 | 42 | | services, maintains, pumps, or repairs an on-site sewage disposal |
---|
43 | 43 | | system or any part of an on-site sewage disposal system for |
---|
44 | 44 | | compensation must hold a license or registration issued by the |
---|
45 | 45 | | commission under Chapter 37, Water Code. |
---|
46 | 46 | | SECTION 5. (a) Section 366.0512, Water Code, as amended by |
---|
47 | 47 | | this Act, applies only to a permit application for an on-site |
---|
48 | 48 | | disposal system filed with the Texas Commission on Environmental |
---|
49 | 49 | | Quality on or after the effective date of this Act. A permit |
---|
50 | 50 | | application filed before the effective date of this Act is governed |
---|
51 | 51 | | by the law in effect on the date of filing, and that law is continued |
---|
52 | 52 | | in effect for that purpose. |
---|
53 | 53 | | (b) Section 366.052(a), Water Code, as amended by this Act, |
---|
54 | 54 | | applies only to a residence for which construction begins on or |
---|
55 | 55 | | after the effective date of this Act. A residence for which |
---|
56 | 56 | | construction began before the effective date of this Act is |
---|
57 | 57 | | governed by the law in effect when construction began, and the |
---|
58 | 58 | | former law is continued in effect for that purpose. |
---|
59 | 59 | | SECTION 6. This Act takes effect September 1, 2019. |
