55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to regulation of on-site sewage disposal systems including
88 occupational licensure requirements associated with those systems.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 366.002(7), Health and Safety Code, is
1111 amended to read as follows:
1212 (7) "On-site sewage disposal system" means one or more
1313 systems of treatment devices and disposal facilities that:
1414 (A) produce not more than 10,000 [5,000] gallons
1515 of waste each day; and
1616 (B) are used only for disposal of sewage produced
1717 on a site on which any part of the system is located.
1818 SECTION 2. Section 366.0512, Health and Safety Code, is
1919 amended to read as follows:
2020 Sec. 366.0512. MULTIPLE TREATMENT SYSTEMS. A multiple
2121 system of treatment devices and disposal facilities may be
2222 permitted as an on-site disposal system under this chapter if the
2323 system:
2424 (1) is located on a tract of land of at least 100 acres
2525 in size;
2626 (2) produces not more than 10,000 [5,000] gallons a
2727 day on an annual average basis;
2828 (3) is used only on a seasonal or intermittent basis;
2929 and
3030 (4) is used only for disposal of sewage produced on the
3131 tract of land on which any part of the system is located.
3232 SECTION 3. Section 366.052(a), Health and Safety Code, is
3333 amended to read as follows:
3434 (a) Sections 366.051, 366.053, 366.054, and 366.057 do not
3535 apply to an on-site sewage disposal system of a single residence
3636 that is located on a land tract that is 1,000 [10] acres or larger in
3737 which the field line or sewage disposal line is not closer than 100
3838 feet of the property line.
3939 SECTION 4. Section 366.071(a), Health and Safety Code, is
4040 amended to read as follows:
4141 (a) A person who constructs, installs, alters, extends,
4242 services, maintains, pumps, or repairs an on-site sewage disposal
4343 system or any part of an on-site sewage disposal system for
4444 compensation must hold a license or registration issued by the
4545 commission under Chapter 37, Water Code.
4646 SECTION 5. (a) Section 366.0512, Water Code, as amended by
4747 this Act, applies only to a permit application for an on-site
4848 disposal system filed with the Texas Commission on Environmental
4949 Quality on or after the effective date of this Act. A permit
5050 application filed before the effective date of this Act is governed
5151 by the law in effect on the date of filing, and that law is continued
5252 in effect for that purpose.
5353 (b) Section 366.052(a), Water Code, as amended by this Act,
5454 applies only to a residence for which construction begins on or
5555 after the effective date of this Act. A residence for which
5656 construction began before the effective date of this Act is
5757 governed by the law in effect when construction began, and the
5858 former law is continued in effect for that purpose.
5959 SECTION 6. This Act takes effect September 1, 2019.
