55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to a strategic plan to reduce recidivism by facilitating
88 stable employment for persons who are preparing to reenter
99 communities of this state after incarceration.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter C, Chapter 501, Government Code, is
1212 amended by adding Section 501.104 to read as follows:
1313 Sec. 501.104. PLAN FOR REDUCING RECIDIVISM BY FACILITATING
1414 STABLE EMPLOYMENT. (a) Not later than December 1, 2020, the
1515 department, in collaboration with the Texas Workforce Commission
1616 and the Office of Court Administration of the Texas Judicial
1717 System, shall develop a five-year strategic plan to reduce
1818 recidivism by facilitating stable employment for persons who are
1919 reentering communities of this state after incarceration. The
2020 department shall submit the plan to:
2121 (1) the governor;
2222 (2) the lieutenant governor;
2323 (3) the speaker of the house of representatives; and
2424 (4) the standing committees of the house and senate
2525 primarily responsible for criminal justice issues and corrections
2626 issues.
2727 (b) The strategic plan must include the following
2828 information:
2929 (1) an analysis of data regarding the relationship
3030 between employment and recidivism;
3131 (2) an analysis of data regarding the effect of
3232 incarceration on a person's ability to pay financial obligations,
3333 including fines, fees, court costs, and child support;
3434 (3) an analysis of barriers to employment faced by
3535 persons who are reentering communities of this state after
3636 incarceration;
3737 (4) recommendations on how the comprehensive reentry
3838 and reintegration plan adopted under Section 501.092 should be
3939 amended to support the strategic plan;
4040 (5) recommendations to the legislature for statutory
4141 changes that would allow the department to assist incarcerated
4242 persons in obtaining credits or wages that would reduce any
4343 financial obligations before and after reentry;
4444 (6) an evaluation of opportunities for incarcerated
4545 persons to earn credit toward occupational licenses while
4646 incarcerated; and
4747 (7) a design for a pilot program that would train
4848 incarcerated persons, pay a private sector wage, and deposit a
4949 portion of those wages in an account from which payments for
5050 financial obligations may be withdrawn.
5151 (c) This section expires September 1, 2021.
5252 SECTION 2. This Act takes effect September 1, 2019.
