55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to a requirement to make certain environmental and water
88 use permit applications available online.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 5.552, Water Code, is amended by
1111 amending Subsection (b) and adding Subsection (b-1) to read as
1212 follows:
1313 (b) Not later than the 30th day after the date the executive
1414 director determines the application to be administratively
1515 complete:
1616 (1) the applicant shall:
1717 (A) post a copy of the application on a publicly
1818 accessible Internet website and provide to the commission the
1919 address of that website; and
2020 (B) publish, [notice of intent to obtain a
2121 permit] at least once in the newspaper of largest circulation in the
2222 county in which the facility to which the application relates is
2323 located or proposed to be located or, if the facility to which the
2424 application relates is located or proposed to be located in a
2525 municipality, at least once in a newspaper of general circulation
2626 in the municipality, a notice of intent to obtain a permit that
2727 includes the Internet website address provided under Paragraph (A);
2828 and
2929 (2) the chief clerk of the commission shall mail
3030 notice of intent to obtain a permit to:
3131 (A) the state senator and representative who
3232 represent the general area in which the facility is located or
3333 proposed to be located;
3434 (B) the mayor and health authorities of the
3535 municipality in which the facility is located or proposed to be
3636 located;
3737 (C) the county judge and health authorities of
3838 the county in which the facility is located or proposed to be
3939 located; and
4040 (D) the river authority in which the facility is
4141 located or proposed to be located if the application is under
4242 Chapter 26[, Water Code].
4343 (b-1) The applicant shall:
4444 (1) post at the Internet website address described by
4545 Subsection (b)(1) any subsequent revision or supplement to the
4646 application as the revision or supplement becomes available; and
4747 (2) maintain the posting at the Internet website
4848 address described by Subsection (b)(1) until the commission takes
4949 final action on the application.
5050 SECTION 2. Section 11.124, Water Code, is amended by adding
5151 Subsection (g) to read as follows:
5252 (g) The applicant shall post a copy of the application, map,
5353 and any supporting materials required by this subchapter on a
5454 publicly accessible Internet website and provide the commission
5555 with the address of that website in the application sent to the
5656 commission under this section. The applicant shall:
5757 (1) post any subsequent revision or supplement to the
5858 application as the revision or supplement becomes available; and
5959 (2) maintain the posting until the commission takes
6060 final action on the application.
6161 SECTION 3. Section 11.132(c), Water Code, is amended to
6262 read as follows:
6363 (c) In the notice, the commission shall:
6464 (1) state the name and address of the applicant;
6565 (2) state the date the application was filed;
6666 (3) state the purpose and extent of the proposed
6767 appropriation of water;
6868 (4) identify the source of supply and the place where
6969 the water is to be stored or taken or diverted from the source of
7070 supply;
7171 (5) identify any proposed alternative source of water,
7272 other than state water, identified by the applicant;
7373 (6) specify the time and location where the commission
7474 will consider the application;
7575 (7) provide the Internet website address of the posted
7676 application, map, and supporting materials; and
7777 (8) [(7)] give any additional information the
7878 commission considers necessary.
7979 SECTION 4. The changes in law made by this Act apply only to
8080 an application received by the Texas Commission on Environmental
8181 Quality on or after the effective date of this Act. An application
8282 received before the effective date of this Act is governed by the
8383 law in effect on the date the application was received, and the
8484 former law is continued in effect for that purpose.
8585 SECTION 5. This Act takes effect September 1, 2019.
