77 relating to the provision of information and other services
88 relating to emergency contraception to sexual assault survivors.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 323, Health and Safety Code, is amended
1111 by adding Sections 323.0052 and 323.0053 to read as follows:
1212 Sec. 323.0052. EMERGENCY CONTRACEPTION INFORMATION. (a)
1313 The department shall develop a standard information form for sexual
1414 assault survivors that includes information regarding emergency
1515 contraception.
1616 (b) Emergency contraception information contained in the
1717 information form must be medically and factually accurate and
1818 unbiased. The department may use appropriate medical organizations
1919 and associations, including the American Congress of Obstetricians
2020 and Gynecologists, as resources in developing the form.
2121 (c) The department shall ensure the emergency contraception
2222 information is published in:
2323 (1) an easily comprehensible form; and
2424 (2) a large, clearly legible typeface.
2525 (d) The department shall annually review the information
2626 form to determine whether content changes are necessary.
2727 (e) A health care facility shall use the information form
2828 developed under this section.
2929 Sec. 323.0053. EMERGENCY SERVICES RELATING TO EMERGENCY
3030 CONTRACEPTION. (a) In addition to the other services and
3131 information required under this chapter, after a sexual assault
3232 survivor arrives at a health care facility for emergency care
3333 following an alleged sexual assault, the facility shall:
3434 (1) provide the survivor with the information form
3535 required under Section 323.0052;
3636 (2) orally communicate to the survivor the information
3737 regarding emergency contraception contained in the form provided
3838 under Subdivision (1);
3939 (3) if indicated by the history of contact, orally
4040 inform the survivor that the survivor may request and receive
4141 emergency contraception at the facility; and
4242 (4) if not medically contraindicated and if the
4343 survivor agrees to submit to a pregnancy test that produces a
4444 negative result, dispense emergency contraception to the survivor
4545 immediately on the survivor's request.
4646 (b) Subsections (a)(3) and (4) do not apply to a health care
4747 facility that does not dispense emergency contraception.
4848 SECTION 2. This Act takes effect September 1, 2019.
