10 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
---|
11 | 13 | | SECTION 1. Sections 521.009(a), (a-1), and (c), |
---|
12 | 14 | | Transportation Code, are amended to read as follows: |
---|
13 | 15 | | (a) The department may establish a program for the provision |
---|
14 | 16 | | of renewal and duplicate driver's license, election identification |
---|
15 | 17 | | certificate, and personal identification certificate services by |
---|
16 | 18 | | [in] counties, [and] municipalities, and private vendors that enter |
---|
17 | 19 | | into an agreement with the department under Subsection (a-1). |
---|
18 | 20 | | (a-1) Under the program, the department may enter into an |
---|
19 | 21 | | agreement with the commissioners court of a county, [or] the |
---|
20 | 22 | | governing body of a municipality, or a private vendor to permit |
---|
21 | 23 | | county, [or] municipal, or vendor employees to provide services at |
---|
22 | 24 | | a county or municipal office or at a location determined by the |
---|
23 | 25 | | vendor relating to the issuance of renewal and duplicate driver's |
---|
24 | 26 | | licenses, election identification certificates, and personal |
---|
25 | 27 | | identification certificates, including: |
---|
26 | 28 | | (1) taking photographs; |
---|
27 | 29 | | (2) administering vision tests; |
---|
28 | 30 | | (3) updating a driver's license, election |
---|
29 | 31 | | identification certificate, or personal identification certificate |
---|
30 | 32 | | to change a name, address, or photograph; |
---|
31 | 33 | | (4) distributing and collecting information relating |
---|
32 | 34 | | to donations under Section 521.401; |
---|
33 | 35 | | (5) collecting fees; and |
---|
34 | 36 | | (6) performing other basic ministerial functions and |
---|
35 | 37 | | tasks necessary to issue renewal and duplicate driver's licenses, |
---|
36 | 38 | | election identification certificates, and personal identification |
---|
37 | 39 | | certificates. |
---|
38 | 40 | | (c) A participating county, [or] municipality, or private |
---|
39 | 41 | | vendor must remit to the department for deposit as required by this |
---|
40 | 42 | | chapter fees collected for the issuance of a renewal or duplicate |
---|
41 | 43 | | driver's license or personal identification certificate. |
---|
42 | | - | SECTION 2. Section 521.165, Transportation Code, is amended |
---|
43 | | - | by amending Subsection (e) and adding Subsection (f) to read as |
---|
44 | | - | follows: |
---|
45 | | - | (e) The department may authorize and set standards for an |
---|
46 | | - | entity described by Subsection (a), including a driver education |
---|
47 | | - | school described by Section 521.1655, to administer, and train and |
---|
48 | | - | certify examiners to administer, the examination required by |
---|
49 | | - | Section 521.161(b)(2). |
---|
50 | | - | (f) An entity described by Subsection (a) may not issue a |
---|
51 | | - | temporary receipt under Section 521.1812 to a person who has not |
---|
52 | | - | passed the testing conducted by the entity under this section. |
---|
53 | | - | SECTION 3. Subchapter I, Chapter 521, Transportation Code, |
---|
54 | | - | is amended by adding Section 521.1812 to read as follows: |
---|
55 | | - | Sec. 521.1812. ISSUANCE OF TEMPORARY RECEIPT BY THIRD |
---|
56 | | - | PARTY. (a) The department may authorize an entity described by |
---|
57 | | - | Section 521.165, including a driver education school described by |
---|
58 | | - | Section 521.1655, to issue a temporary receipt to a qualifying |
---|
59 | | - | applicant who has met all requirements for a driver's license if the |
---|
60 | | - | qualifying applicant holds a learner license issued by the |
---|
61 | | - | department under Section 521.222. |
---|
62 | | - | (b) A temporary receipt issued under Subsection (a) serves |
---|
63 | | - | as temporary permission to operate a vehicle until the department |
---|
64 | | - | provides a driver's license to the qualifying applicant. |
---|
65 | | - | (c) The department shall develop a process for an entity |
---|
66 | | - | under Subsection (a) to electronically transmit to the department |
---|
67 | | - | the documents and information required by the department for the |
---|
68 | | - | issuance of a driver's license to a qualifying applicant. |
---|
69 | | - | (d) The department shall adopt rules to implement this |
---|
70 | | - | section. |
---|
71 | | - | SECTION 4. Sections 521.271(a) and (b), Transportation |
---|

73 | 46 | | (a) Each original driver's license, provisional license, |
---|
74 | 47 | | learner license, or occupational driver's license issued to an |

75 | 48 | | applicant who is a citizen, national, or legal permanent resident |
---|
76 | 49 | | of the United States or a refugee or asylee lawfully admitted into |
---|
77 | 50 | | the United States expires as follows: |
---|
78 | 51 | | (1) except as provided by Section 521.2711, a driver's |
---|
79 | 52 | | license expires on the first birthday of the license holder |
---|
80 | 53 | | occurring after the eighth [sixth] anniversary of the date of the |
---|
81 | 54 | | application; |
---|
82 | 55 | | (2) a provisional license expires on the 18th |
---|
83 | 56 | | birthday of the license holder; |
---|
84 | 57 | | (3) a learner license expires on the 18th birthday of |
---|
85 | 58 | | the license holder; |
---|
86 | 59 | | (4) an occupational driver's license expires on the |
---|
87 | 60 | | first anniversary of the court order granting the license; and |
---|
88 | 61 | | (5) unless an earlier date is otherwise provided, a |
---|
89 | 62 | | driver's license issued to a person whose residence or domicile is a |
---|
90 | 63 | | correctional facility or a parole facility expires on the first |
---|
91 | 64 | | birthday of the license holder occurring after the first |
---|
92 | 65 | | anniversary of the date of issuance. |
---|
93 | 66 | | (b) Except as provided by Section 521.2711, a driver's |
---|
94 | 67 | | license that is renewed expires on the earlier of: |
---|
95 | 68 | | (1) the eighth [sixth] anniversary of the expiration |
---|
96 | 69 | | date before renewal if the applicant is a citizen, national, or |
---|
97 | 70 | | legal permanent resident of the United States or a refugee or asylee |
---|
98 | 71 | | lawfully admitted into the United States; |
---|
99 | 72 | | (1-a) for an applicant not described by Subdivision |
---|
100 | 73 | | (1): |
---|
101 | 74 | | (A) the earlier of: |
---|
102 | 75 | | (i) the eighth [sixth] anniversary of the |
---|
103 | 76 | | expiration date before renewal; or |
---|
104 | 77 | | (ii) the expiration date of the applicant's |
---|
105 | 78 | | authorized stay in the United States; or |
---|
106 | 79 | | (B) the first anniversary of the date of |
---|
107 | 80 | | issuance, if there is no definite expiration date for the |
---|
108 | 81 | | applicant's authorized stay in the United States; or |
---|
109 | 82 | | (2) for a renewal driver's license issued to a person |
---|
110 | 83 | | whose residence or domicile is a correctional facility or a parole |

111 | 84 | | facility, the first birthday of the license holder occurring after |

112 | 85 | | the first anniversary of the date of issuance unless an earlier date |
---|
113 | 86 | | is otherwise provided. |

150 | 123 | | year after the date of issuance of the commercial driver's license |
---|
151 | 124 | | or that has been expired for less than one year expires eight [five] |
---|
152 | 125 | | years after the expiration date shown on the Class A, B, C, or M |
---|
153 | 126 | | license. |
---|
154 | 127 | | (d) Except as provided by Subsection (l) and Section |

155 | 128 | | 522.054, a commercial driver's license issued to a person holding a |
---|
156 | 129 | | Texas Class A, B, C, or M license that has been expired for at least |
---|
157 | 130 | | one year but not more than two years expires eight [five] years |
---|
158 | 131 | | after the applicant's last birthday. |

159 | 132 | | (f) Except as provided by Section 522.013, a non-domiciled |
---|
160 | 133 | | commercial driver's license other than a temporary non-domiciled |
---|
161 | 134 | | commercial driver's license under Section 522.013(e) expires on: |

162 | 135 | | (1) the earlier of: |
---|
163 | 136 | | (A) the first birthday of the license holder |
---|
164 | 137 | | occurring after the eighth [fifth] anniversary of the date of the |
---|
165 | 138 | | application; or |
---|
166 | 139 | | (B) the expiration date of the license holder's |
---|
167 | 140 | | lawful presence in the United States as determined by the |
---|
168 | 141 | | appropriate United States agency in compliance with federal law; or |
---|
169 | 142 | | (2) the first anniversary of the date of issuance, if |
---|
170 | 143 | | there is no definitive expiration date for the applicant's |
---|
171 | 144 | | authorized stay in the United States. |
---|
172 | 145 | | (i) Except as provided by Subsection (f) and Sections |

173 | 146 | | 522.013(e), 522.033, and 522.054, an original commercial driver's |
---|
174 | 147 | | license with a hazardous materials endorsement expires five years |
---|
175 | 148 | | after the applicant's next birthday. |
---|
176 | 149 | | (j) Except as provided by Section 522.054, a commercial |
---|
177 | 150 | | driver's license with a hazardous materials endorsement issued to a |

178 | 151 | | person holding a Texas Class A, B, C, or M license that would expire |
---|
179 | 152 | | one year or more after the date of issuance of the commercial |
---|
180 | 153 | | driver's license expires five years after the applicant's next |
---|
181 | 154 | | birthday. |
---|
182 | 155 | | (k) Except as provided by Section 522.054, a commercial |
---|
183 | 156 | | driver's license with a hazardous materials endorsement issued to a |
---|
184 | 157 | | person holding a Texas Class A, B, C, or M license that would expire |
---|
185 | 158 | | less than one year after the date of issuance of the commercial |
---|
186 | 159 | | driver's license or that has been expired for less than one year |
---|
187 | 160 | | expires five years after the expiration date shown on the Class A, |
---|
188 | 161 | | B, C, or M license. |
---|
189 | 162 | | (l) Except as provided by Section 522.054, a commercial |

190 | 163 | | driver's license with a hazardous materials endorsement issued to a |

191 | 164 | | person holding a Texas Class A, B, C, or M license that has been |

192 | 165 | | expired for at least one year but not more than two years expires |
