44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to pharmacy licensure requirements for certain
77 pharmacies; providing an administrative penalty.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 560.052(b), Occupations Code, is amended
1010 to read as follows:
1111 (b) To qualify for a pharmacy license, an applicant must
1212 submit to the board:
1313 (1) a license fee set by the board, except as provided
1414 by Subsection (d); [and]
1515 (2) a completed application that:
1616 (A) is on a form prescribed by the board;
1717 (B) is given under oath;
1818 (C) includes proof that:
1919 (i) a pharmacy license held by the
2020 applicant in this state or another state, if applicable, has not
2121 been restricted, suspended, revoked, or surrendered for any reason;
2222 and
2323 (ii) no owner of the pharmacy for which the
2424 application is made has held a pharmacist license in this state or
2525 another state, if applicable, that has been restricted, suspended,
2626 revoked, or surrendered for any reason; and
2727 (D) includes a statement of:
2828 (i) the ownership;
2929 (ii) the location of the pharmacy;
3030 (iii) the license number of each pharmacist
3131 who is employed by the pharmacy, if the pharmacy is located in this
3232 state, or who is licensed to practice pharmacy in this state, if the
3333 pharmacy is located in another state;
3434 (iv) the pharmacist license number of the
3535 pharmacist-in-charge; and
3636 (v) any other information the board
3737 determines necessary; and
3838 (3) if the applicant is not a pharmacy operated by a
3939 publicly traded company:
4040 (A) a statement disclosing:
4141 (i) the pharmacy's financial investors as
4242 provided by Section 560.0521; and
4343 (ii) the criminal history record
4444 information of each individual owner and financial investor of the
4545 pharmacy, or of each individual managing officer of the pharmacy if
4646 the pharmacy is a partnership or closely held corporation,
4747 accompanied by a complete and legible set of fingerprints of each
4848 individual owner, financial investor, and managing officer, as
4949 applicable; and
5050 SECTION 2. Subchapter B, Chapter 560, Occupations Code, is
5151 amended by adding Sections 560.0521 and 560.0522 to read as
5252 follows:
5353 Sec. 560.0521. FINANCIAL INVESTOR DISCLOSURE STATEMENT.
5454 (a) A disclosure statement of financial investors included with an
5555 application under Section 560.052(b)(3) must include:
5656 (1) the name of each person who is financially
5757 invested in the pharmacy;
5858 (2) the total amount of the financial investment made
5959 by each person; and
6060 (3) the source of the financial investment as required
6161 by Subsection (b).
6262 (b) The disclosure of the source of a financial investment
6363 required by Subsection (a)(3) must include:
6464 (1) if the source is money from a checking or savings
6565 account at a financial institution:
6666 (A) the name and address of the financial
6767 institution; and
6868 (B) the account number from which the financial
6969 investment was obtained or in which the financial investment is
7070 maintained;
7171 (2) if the source is from the sale of property:
7272 (A) the type of property sold; and
7373 (B) if the property sold is real property:
7474 (i) the property's address;
7575 (ii) the buyer's name and address;
7676 (iii) the date of the sale; and
7777 (iv) the amount of the net proceeds from the
7878 sale of the property;
7979 (3) if the source is from a loan:
8080 (A) the date the loan was made;
8181 (B) the amount and terms of the loan;
8282 (C) the collateral securing the loan, if any;
8383 (D) the name and address of the lender; and
8484 (E) a copy of the loan agreement;
8585 (4) if the source is from an inheritance or gift:
8686 (A) the amount of the inheritance or gift; and
8787 (B) the donor's name, address, and relation to
8888 the investor, if any; and
8989 (5) a description of any other source not specified by
9090 this subsection.
9191 SECTION 4. Section 566.001, Occupations Code, is amended to
9292 read as follows:
9393 Sec. 566.001. IMPOSITION OF PENALTY. The board may impose
9494 an administrative penalty on:
9595 (1) a person licensed or regulated under this subtitle
9696 who violates this subtitle or a rule or order adopted under this
9797 subtitle; and
9898 (2) an applicant who fails to disclose criminal
9999 history record information in the manner required by Section
100100 560.052(b).
101101 SECTION 5. The changes in law made by this Act apply to an
102102 application for a pharmacy license or a renewal that is submitted or
103103 a change of ownership by a pharmacy that occurs on or after the
104104 effective date of this Act.
105105 SECTION 6. This Act takes effect September 1, 2019.
