9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Subchapter E, Chapter 261, Family Code, is | |
11 | 11 | amended by adding Section 261.411 to read as follows: | |
12 | 12 | Sec. 261.411. INVESTIGATIONS IN RESIDENTIAL DETENTION | |
13 | 13 | FACILITIES. (a) This section applies only to a residential | |
14 | 14 | child-care facility that: | |
15 | 15 | (1) is operated by or under a contract with United | |
16 | 16 | States Immigration and Customs Enforcement to enforce federal | |
17 | 17 | immigration laws; and | |
18 | 18 | (2) detains children. | |
19 | 19 | (b) The Health and Human Services Commission shall adopt | |
20 | 20 | rules relating to the commission's investigation of allegations of | |
21 | 21 | abuse or neglect in a residential child-care facility described by | |
22 | 22 | Subsection (a). | |
23 | 23 | (c) The rules must require the commission to: | |
24 | 24 | (1) immediately investigate an allegation of abuse or | |
25 | 25 | neglect of a child detained in a residential child-care facility | |
26 | 26 | described by Subsection (a); | |
27 | 27 | (2) communicate with the child who is the alleged | |
28 | 28 | victim of the abuse or neglect and the alleged victim's family; and | |
29 | 29 | (3) ensure the alleged victim is provided | |
30 | 30 | opportunities to communicate with the victim's parent, guardian, or | |
31 | 31 | another family member. | |
32 | 32 | SECTION 2. This Act takes effect September 1, 2019. |
