66 AN ACT
77 relating to the investigation of allegations of abuse and neglect
88 in a residential detention facility.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter E, Chapter 261, Family Code, is
1111 amended by adding Section 261.411 to read as follows:
1212 Sec. 261.411. INVESTIGATIONS IN RESIDENTIAL DETENTION
1313 FACILITIES. (a) This section applies only to a residential
1414 child-care facility that:
1515 (1) is operated by or under a contract with United
1616 States Immigration and Customs Enforcement to enforce federal
1717 immigration laws; and
1818 (2) detains children.
1919 (b) The Health and Human Services Commission shall adopt
2020 rules relating to the commission's investigation of allegations of
2121 abuse or neglect in a residential child-care facility described by
2222 Subsection (a).
2323 (c) The rules must require the commission to:
2424 (1) immediately investigate an allegation of abuse or
2525 neglect of a child detained in a residential child-care facility
2626 described by Subsection (a);
2727 (2) communicate with the child who is the alleged
2828 victim of the abuse or neglect and the alleged victim's family; and
2929 (3) ensure the alleged victim is provided
3030 opportunities to communicate with the victim's parent, guardian, or
3131 another family member.
3232 SECTION 2. This Act takes effect September 1, 2019.
