410 AN ACT
511 relating to the designation of a property as a historic landmark by
612 a municipality.
713 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
814 SECTION 1. Subchapter A, Chapter 211, Local Government
915 Code, is amended by adding Section 211.0165 to read as follows:
1016 Sec. 211.0165. DESIGNATION OF HISTORIC LANDMARK. (a)
1117 Except as provided by Subsection (b), a municipality that has
1218 established a process for designating places or areas of
1319 historical, cultural, or architectural importance and significance
1420 through the adoption of zoning regulations or zoning district
1521 boundaries may not designate a property as a local historic
1622 landmark unless:
1723 (1) the owner of the property consents to the
1824 designation; or
1925 (2) the designation is approved by a three-fourths
2026 vote of:
2127 (A) the governing body of the municipality; and
2228 (B) the zoning, planning, or historical
2329 commission of the municipality, if any.
2430 (b) If the property is owned by an organization that
2531 qualifies as a religious organization under Section 11.20, Tax
2632 Code, the municipality may designate the property as a local
2733 historic landmark only if the organization consents to the
2834 designation.
2935 (c) The municipality must provide the property owner a
3036 statement that describes the impact that a historic designation of
3137 the owner's property may have on the owner and the owner's property.
3238 The municipality must provide the statement to the owner not later
3339 than the 15th day before the date of the initial hearing on the
3440 historic designation of the property of:
3541 (1) the zoning, planning, or historical commission, if
3642 any; or
3743 (2) the governing body of the municipality.
3844 (d) The historic designation impact statement must include
3945 lists of the:
4046 (1) regulations that may be applied to any structure
4147 on the property after the designation;
4248 (2) procedures for the designation;
4349 (3) tax benefits that may be applied to the property
4450 after the designation; and
4551 (4) rehabilitation or repair programs that the
4652 municipality offers for a property designated as historic.
4753 (e) The municipality must allow an owner to withdraw consent
4854 at any time during the designation process.
4955 SECTION 2. Section 211.0165, Local Government Code, as
5056 added by this Act, applies only to a designation of a property as a
5157 historic landmark made on or after the effective date of this Act.
5258 SECTION 3. This Act takes effect immediately if it receives
5359 a vote of two-thirds of all the members elected to each house, as
5460 provided by Section 39, Article III, Texas Constitution. If this
5561 Act does not receive the vote necessary for immediate effect, this
5662 Act takes effect September 1, 2019.
