9 | 15 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 16 | | SECTION 1. Subchapter K, Chapter 42A, Code of Criminal |
---|
11 | 17 | | Procedure, is amended by adding Article 42A.515 to read as follows: |

12 | 18 | | Art. 42A.515. COMMUNITY SUPERVISION FOR LEAVING SCENE OF |
---|
13 | 19 | | MOTOR VEHICLE ACCIDENT RESULTING IN DEATH OF PERSON. (a) A judge |
---|
14 | 20 | | granting community supervision to a defendant convicted of an |
---|
15 | 21 | | offense punishable under Section 550.021(c)(1)(A), Transportation |
---|
16 | 22 | | Code, shall require as a condition of community supervision that |
---|
17 | 23 | | the defendant submit to a term of confinement of not less than 120 |
---|
18 | 24 | | days. |
---|
19 | 25 | | (b) If a sentence of confinement is imposed on the |
---|
20 | 26 | | revocation of community supervision, the term of confinement served |
---|
21 | 27 | | under Subsection (a) may not be credited toward completion of the |
---|
22 | 28 | | sentence imposed. |
---|
23 | 29 | | SECTION 2. The change in law made by this Act applies only |
---|
24 | 30 | | to an offense committed on or after the effective date of this Act. |
---|
25 | 31 | | An offense committed before the effective date of this Act is |
---|
26 | 32 | | governed by the law in effect on the date the offense was committed, |
---|
27 | 33 | | and the former law is continued in effect for that purpose. For |
---|
28 | 34 | | purposes of this section, an offense was committed before the |
---|
29 | 35 | | effective date of this Act if any element of the offense occurred |
---|
30 | 36 | | before that date. |
---|
31 | 37 | | SECTION 3. This Act takes effect September 1, 2019. |
