| 5 | 11 | | relating to workers' compensation death benefit eligibility for |

| 6 | 12 | | certain spouses of certain employees killed in the line of duty. |

| 7 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 14 | | SECTION 1. Section 408.183(b-1), Labor Code, is amended to |
|---|
| 9 | 15 | | read as follows: |
|---|
| 10 | 16 | | (b-1) Notwithstanding Subsection (b), an eligible spouse |
|---|
| 11 | 17 | | who remarried is eligible for death benefits for life if the |
|---|
| 12 | 18 | | employee was a first responder, as defined by Section 504.055, or an |
|---|
| 13 | 19 | | individual described by Section 615.003(1), Government Code, or |
|---|
| 14 | 20 | | Section 501.001(5)(F), who suffered death in the course and scope |
|---|
| 15 | 21 | | of employment or while providing services as a volunteer. This |
|---|
| 16 | 22 | | subsection applies regardless of the date on which the death of the |
|---|
| 17 | 23 | | first responder or other individual occurred. |
|---|
| 18 | 24 | | SECTION 2. The change in law made by this Act to Section |
|---|
| 19 | 25 | | 408.183(b-1), Labor Code, applies only to an eligible spouse who |
|---|
| 20 | 26 | | remarries on or after the effective date of this Act. An eligible |
|---|
| 21 | 27 | | spouse who remarried before that date is governed by the law as it |
|---|
| 22 | 28 | | existed immediately before the effective date of this Act, and the |
|---|
| 23 | 29 | | former law is continued in effect for that purpose. |

| 24 | 30 | | SECTION 3. This Act takes effect September 1, 2019. |
