5	11		relating to candidates nominated by convention.
6	12		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
7	13		SECTION 1. Subchapter B, Chapter 141, Election Code, is
8	14		amended by adding Section 141.041 to read as follows:
9	15		Sec. 141.041. FILING FEE OR PETITION TO APPEAR ON BALLOT FOR
10	16		GENERAL ELECTION FOR STATE AND COUNTY OFFICERS. (a) In addition
11	17		to any other requirements, to be eligible to be placed on the ballot
12	18		for the general election for state and county officers, a candidate
13	19		who is nominated by convention under Chapter 181 or 182 must:
14	20		(1) pay a filing fee to the secretary of state for a
15	21		statewide or district office or the county judge for a county or
16	22		precinct office; or
17	23		(2) submit to the secretary of state for a statewide or
18	24		district office or the county judge for a county or precinct office
19	25		a petition in lieu of a filing fee that satisfies the requirements
20	26		prescribed by Subsection (e) and Section 141.062.
21	27		(b) The amount of the filing fee is the amount prescribed by
22	28		Section 172.024 for a candidate for nomination for the same office
23	29		in a general primary election.
24	30		(c) A filing fee received by the secretary of state shall be
25	31		deposited in the state treasury to the credit of the general revenue
26	32		fund.
27	33		(d) A filing fee received by the county judge shall be
28	34		deposited in the county treasury to the credit of the county general
29	35		fund.
30	36		(e) The minimum number of signatures that must appear on the
31	37		petition authorized by Subsection (a) is the number prescribed by
32	38		Section 172.025 to appear on a petition of a candidate for
33	39		nomination for the same office in a general primary election.
34	40		(f) The secretary of state shall adopt rules as necessary to
35	41		implement this section.
36	42		SECTION 2. Section 181.005, Election Code, is amended by
37	43		adding Subsection (c) to read as follows:
38	44		(c) A political party is entitled to have the names of its
39	45		nominees placed on the general election ballot, without qualifying
40	46		under Subsection (a) or (b), if the party had a nominee for a
41	47		statewide office who received a number of votes equal to at least
42	48		two percent of the total number of votes received by all candidates
43	49		for that office at least once in the five previous general
44	50		elections.
45	51		SECTION 3. This Act takes effect September 1, 2019.
