| 6 | 12 | | child custody evaluation. |

| 7 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 14 | | SECTION 1. Section 107.106, Family Code, is amended by |
|---|
| 9 | 15 | | amending Subsection (a) and adding Subsection (a-1) to read as |
|---|
| 10 | 16 | | follows: |
|---|
| 11 | 17 | | (a) This section applies only to a county: |
|---|
| 12 | 18 | | (1) with a population of less than 500,000; |
|---|
| 13 | 19 | | (2) that is contiguous to the Gulf of Mexico or a bay |
|---|
| 14 | 20 | | or inlet opening into the gulf and that borders the United Mexican |
|---|
| 15 | 21 | | States; or |
|---|
| 16 | 22 | | (3) that borders a county described by Subdivision |
|---|
| 17 | 23 | | (2). |
|---|
| 18 | 24 | | (a-1) In a county to which this section applies [with a |
|---|
| 19 | 25 | | population of less than 500,000], if a court finds that an |
|---|
| 20 | 26 | | individual who meets the requirements of Section 107.104 is not |
|---|
| 21 | 27 | | available in the county to conduct a child custody evaluation in a |
|---|
| 22 | 28 | | timely manner, the court, after notice and hearing or on agreement |
|---|
| 23 | 29 | | of the parties, may appoint an individual the court determines to be |
|---|
| 24 | 30 | | otherwise qualified to conduct the evaluation. |
|---|
| 25 | 31 | | SECTION 2. This Act takes effect September 1, 2019. |
