55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to increasing awareness of the dangers of exposing
88 children to secondhand smoke.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 161.501(a), Health and Safety Code, is
1111 amended to read as follows:
1212 (a) A hospital, birthing center, physician, nurse midwife,
1313 or midwife who provides prenatal care to a pregnant woman during
1414 gestation or at delivery of an infant shall:
1515 (1) provide the woman and the father of the infant, if
1616 possible, or another adult caregiver for the infant, with a
1717 resource pamphlet that includes:
1818 (A) a list of the names, addresses, and phone
1919 numbers of professional organizations that provide postpartum
2020 counseling and assistance to parents relating to postpartum
2121 depression and other emotional trauma associated with pregnancy and
2222 parenting;
2323 (B) information regarding the prevention of
2424 shaken baby syndrome including:
2525 (i) techniques for coping with anger caused
2626 by a crying baby;
2727 (ii) different methods for preventing a
2828 person from shaking a newborn, infant, or other young child;
2929 (iii) the dangerous effects of shaking a
3030 newborn, infant, or other young child; and
3131 (iv) the symptoms of shaken baby syndrome
3232 and who to contact, as recommended by the American Academy of
3333 Pediatrics, if a parent suspects or knows that a baby has been
3434 shaken in order to receive prompt medical treatment;
3535 (C) a list of diseases for which a child is
3636 required by state law to be immunized and the appropriate schedule
3737 for the administration of those immunizations;
3838 (D) the appropriate schedule for follow-up
3939 procedures for newborn screening;
4040 (E) information regarding sudden infant death
4141 syndrome, including current recommendations for infant sleeping
4242 conditions to lower the risk of sudden infant death syndrome;
4343 (F) educational information in both English and
4444 Spanish on:
4545 (i) pertussis disease and the availability
4646 of a vaccine to protect against pertussis, including information on
4747 the Centers for Disease Control and Prevention recommendation that
4848 parents receive Tdap during the postpartum period to protect
4949 newborns from the transmission of pertussis; and
5050 (ii) the incidence of cytomegalovirus,
5151 birth defects caused by congenital cytomegalovirus, and available
5252 resources for the family of an infant born with congenital
5353 cytomegalovirus; [and]
5454 (G) the danger of heatstroke for a child left
5555 unattended in a motor vehicle; and
5656 (H) information in both English and Spanish from
5757 reputable sources, including the Centers for Disease Control and
5858 Prevention and the surgeon general of the United States Public
5959 Health Service, regarding the dangers of exposing a newborn,
6060 infant, or other child to secondhand smoke and available resources
6161 to assist a person who wants to stop smoking;
6262 (2) if the woman is a recipient of medical assistance
6363 under Chapter 32, Human Resources Code, provide the woman and the
6464 father of the infant, if possible, or another adult caregiver with a
6565 resource guide that includes information in both English and
6666 Spanish relating to the development, health, and safety of a child
6767 from birth until age five, including information relating to:
6868 (A) selecting and interacting with a primary
6969 health care practitioner and establishing a "medical home" for the
7070 child;
7171 (B) dental care;
7272 (C) effective parenting;
7373 (D) child safety;
7474 (E) the importance of reading to a child;
7575 (F) expected developmental milestones;
7676 (G) health care resources available in the state;
7777 (H) selecting appropriate child care; and
7878 (I) other resources available in the state;
7979 (3) document in the woman's record that the woman
8080 received the resource pamphlet described in Subdivision (1) and the
8181 resource guide described in Subdivision (2), if applicable; and
8282 (4) retain the documentation for at least five years
8383 in the hospital's, birthing center's, physician's, nurse midwife's,
8484 or midwife's records.
8585 SECTION 2. (a) Not later than December 1, 2019, the
8686 Department of State Health Services shall make the informational
8787 materials required by Section 161.501(a)(1), Health and Safety
8888 Code, as amended by this Act, available on its Internet website.
8989 (b) Notwithstanding Section 161.501(a)(1)(H), Health and
9090 Safety Code, as added by this Act, a facility is not required to
9191 comply with that provision until January 1, 2020.
9292 SECTION 3. This Act takes effect September 1, 2019.
