77 relating to recovery of attorney's fees in certain civil cases.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 38.001, Civil Practice and Remedies
1010 Code, is amended to read as follows:
1111 Sec. 38.001. RECOVERY OF ATTORNEY'S FEES. A person may
1212 recover reasonable attorney's fees from an individual or an
1313 organization, as defined by Section 1.002, Business Organizations
1414 Code [corporation], in addition to the amount of a valid claim and
1515 costs, if the claim is for:
1616 (1) rendered services;
1717 (2) performed labor;
1818 (3) furnished material;
1919 (4) freight or express overcharges;
2020 (5) lost or damaged freight or express;
2121 (6) killed or injured stock;
2222 (7) a sworn account; or
2323 (8) an oral or written contract.
2424 SECTION 2. The change in law made by this Act applies only
2525 to an award of attorney's fees in an action commenced on or after
2626 the effective date of this Act. An award of attorney's fees in an
2727 action commenced before the effective date of this Act is governed
2828 by the law applicable to the award immediately before the effective
2929 date of this Act, and that law is continued in effect for that
3030 purpose.
3131 SECTION 3. This Act takes effect September 1, 2019.
