55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the prohibition on lobbying by certain elected
88 officers.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 141.001, Election Code, is amended by
1111 amending Subsection (a) and adding Subsections (e) and (f) to read
1212 as follows:
1313 (a) To be eligible to be a candidate for, or elected or
1414 appointed to, a public elective office in this state, a person must:
1515 (1) be a United States citizen;
1616 (2) be 18 years of age or older on the first day of the
1717 term to be filled at the election or on the date of appointment, as
1818 applicable;
1919 (3) have not been determined by a final judgment of a
2020 court exercising probate jurisdiction to be:
2121 (A) totally mentally incapacitated; or
2222 (B) partially mentally incapacitated without the
2323 right to vote;
2424 (4) have not been finally convicted of a felony from
2525 which the person has not been pardoned or otherwise released from
2626 the resulting disabilities;
2727 (5) have resided continuously in the state for 12
2828 months and in the territory from which the office is elected for six
2929 months immediately preceding the following date:
3030 (A) for a candidate whose name is to appear on a
3131 general primary election ballot, the date of the regular filing
3232 deadline for a candidate's application for a place on the ballot;
3333 (B) for an independent candidate, the date of the
3434 regular filing deadline for a candidate's application for a place
3535 on the ballot;
3636 (C) for a write-in candidate, the date of the
3737 election at which the candidate's name is written in;
3838 (D) for a party nominee who is nominated by any
3939 method other than by primary election, the date the nomination is
4040 made; and
4141 (E) for an appointee to an office, the date the
4242 appointment is made;
4343 (6) on the date described by Subdivision (5), be
4444 registered to vote in the territory from which the office is
4545 elected; [and]
4646 (7) not be required to be registered as a lobbyist
4747 under Chapter 305, Government Code; and
4848 (8) satisfy any other eligibility requirements
4949 prescribed by law for the office.
5050 (e) Except as restricted by Section 7.103(c), Education
5151 Code, if applicable, Subsection (a)(7) does not apply to:
5252 (1) an office of a political subdivision with a
5353 population of 150,000 or less, other than the office of presiding
5454 officer of the governing body of the political subdivision,
5555 provided that the officeholder does not receive a salary or wage for
5656 that office; or
5757 (2) the office of the presiding officer of the
5858 governing body of a political subdivision with a population of
5959 50,000 or less, provided that the presiding officer does not
6060 receive a salary or wage for that office.
6161 (f) For purposes of Subsection (e), a presiding officer or
6262 other officeholder is not considered to have received a salary or
6363 wage if the officeholder refuses to accept a salary or wage offered
6464 or budgeted for that office.
6565 SECTION 2. Subchapter A, Chapter 305, Government Code, is
6666 amended by adding Section 305.0031 to read as follows:
6767 Sec. 305.0031. CERTAIN ELECTED OFFICERS MAY NOT REGISTER.
6868 (a) A member of Congress, a member of the legislature, or a holder
6969 of a statewide office may not register under this chapter.
7070 (b) A registration under this chapter expires on the date a
7171 person takes office as a member of Congress, a member of the
7272 legislature, or a holder of a statewide office.
7373 SECTION 3. Chapter 601, Government Code, is amended by
7474 adding Section 601.010 to read as follows:
7575 Sec. 601.010. ELECTED OFFICER MAY NOT BE REGISTERED
7676 LOBBYIST. (a) A person may not qualify for a public elective
7777 office if the person is required to be registered as a lobbyist
7878 under Chapter 305.
7979 (b) Except as restricted by Section 7.103(c), Education
8080 Code, if applicable, Subsection (a) does not apply to:
8181 (1) an office for which the federal or state
8282 constitution prescribes exclusive qualification requirements;
8383 (2) an office of a political subdivision with a
8484 population of 150,000 or less, other than the office of presiding
8585 officer of the governing body of the political subdivision,
8686 provided that the officeholder does not receive a salary or wage for
8787 that office; or
8888 (3) the office of the presiding officer of the
8989 governing body of a political subdivision with a population of
9090 50,000 or less, provided that the presiding officer does not
9191 receive a salary or wage for that office.
9292 (c) For purposes of Subsection (b), a presiding officer or
9393 other officeholder is not considered to have received a salary or
9494 wage if the officeholder refuses to accept a salary or wage offered
9595 or budgeted for that office.
9696 SECTION 4. Section 141.001(a), Election Code, as amended by
9797 this Act, and Section 601.010, Government Code, as added by this
9898 Act, apply only to the eligibility and qualification requirements
9999 for a candidate or officer whose term of office will begin on or
100100 after the effective date of this Act. The eligibility and
101101 qualification requirements for a candidate or officer whose term of
102102 office will begin before the effective date of this Act are governed
103103 by the law in effect immediately before the effective date of this
104104 Act, and the former law is continued in effect for that purpose.
105105 SECTION 5. This Act takes effect January 12, 2021.
