| 7 | 7 | | relating to participation in the Texas County and District |
|---|
| 8 | 8 | | Retirement System. |
|---|
| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|---|
| 10 | 10 | | SECTION 1. Section 841.001(17), Government Code, is amended |
|---|
| 11 | 11 | | to read as follows: |
|---|
| 12 | 12 | | (17) "Subdivision" means a political subdivision of |
|---|
| 13 | 13 | | the state that is not eligible to participate in any other statewide |
|---|
| 14 | 14 | | retirement system or that is not currently participating in a |
|---|
| 15 | 15 | | retirement system established by the legislature. The term |
|---|
| 16 | 16 | | includes [the Texas Association of Counties,] the retirement |
|---|
| 17 | 17 | | system[,] and a city-county hospital jointly managed under |
|---|
| 18 | 18 | | Subchapter B, Chapter 265, Health and Safety Code. The term does |
|---|
| 19 | 19 | | not include: |
|---|
| 20 | 20 | | (A) a branch, division, department, employee |
|---|
| 21 | 21 | | classification group, or other separately identified component of a |
|---|
| 22 | 22 | | political subdivision; or |
|---|
| 23 | 23 | | (B) an incorporated nongovernmental entity, |
|---|
| 24 | 24 | | nonprofit corporation, or other external service provider of a |
|---|
| 25 | 25 | | political subdivision. |
|---|
| 26 | 26 | | SECTION 2. (a) The change in law made by this Act does not |
|---|
| 27 | 27 | | affect a person who is a retiree in the Texas County and District |
|---|
| 28 | 28 | | Retirement System before the effective date of this Act, and the |
|---|
| 29 | 29 | | former law is continued in effect for that purpose. |
|---|
| 30 | 30 | | (b) On the effective date of this Act, an individual who is a |
|---|
| 31 | 31 | | member of the Texas County and District Retirement System who is |
|---|
| 32 | 32 | | employed by an entity that is not a subdivision for purposes of |
|---|
| 33 | 33 | | Section 841.001(17), Government Code, as amended by this Act, is |
|---|
| 34 | 34 | | treated as an individual who separates from employment with a |
|---|
| 35 | 35 | | participating subdivision as a vested member of the system, as |
|---|
| 36 | 36 | | defined by Section 841.001, Government Code. |
|---|
| 37 | 37 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 38 | 38 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 39 | 39 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 40 | 40 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 41 | 41 | | Act takes effect September 1, 2019. |
|---|
