4	12		AN ACT
5	13		relating to the energy efficiency performance standards for
6	14		construction of certain industrialized housing.
7	15		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
8	16		SECTION 1. Subchapter D, Chapter 1202, Occupations Code, is
9	17		amended by adding Section 1202.1536 to read as follows:
10	18		Sec. 1202.1536. OPTION TO CONSTRUCT CERTAIN INDUSTRIALIZED
11	19		HOUSING IN ACCORDANCE WITH CERTAIN ENERGY EFFICIENCY PERFORMANCE
12	20		STANDARDS. (a) Notwithstanding any other provision of this
13	21		subchapter related to energy efficiency performance standards, a
14	22		manufacturer or builder of industrialized housing may construct
15	23		single-family industrialized housing in accordance with the energy
16	24		efficiency performance standards outlined in:
17	25		(1) the energy code adopted by the council; or
18	26		(2) the energy code in this state for single-family
19	27		residential construction with any local amendments or alternative
20	28		compliance paths described by Section 388.003, Health and Safety
21	29		Code, that are:
22	30		(A) requested by a municipality, county, or group
23	31		of counties located in the climate zone in which the single-family
24	32		industrialized housing will be located; and
25	33		(B) determined by the laboratory, as defined by
26	34		Section 388.002, Health and Safety Code, to be equally or more
27	35		stringent than the energy code described by Section 388.003(a),
28	36		Health and Safety Code.
29	37		(b) A manufacturer or builder of industrialized housing
30	38		shall maintain and, on request, make available to the department,
31	39		to a design review agency, or to another entity authorized to
32	40		evaluate industrialized housing under this chapter all
33	41		documentation necessary to evaluate single-family industrialized
34	42		housing constructed by the manufacturer or builder in accordance
35	43		with the energy efficiency performance standards described by
36	44		Subsection (a).
37	45		SECTION 2. This Act takes effect September 1, 2019.
