77 relating to procedures relating to the acceptance or rejection of a
88 ballot voted by mail.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter B, Chapter 87, Election Code, is
1111 amended by adding Section 87.0271 to read as follows:
1212 Sec. 87.0271. OPPORTUNITY TO CORRECT DEFECT: SIGNATURE
1313 VERIFICATION COMMITTEE. (a) This section applies to an early
1414 voting ballot voted by mail:
1515 (1) for which the voter did not sign the carrier
1616 envelope certificate; or
1717 (2) for which it cannot be determined whether the
1818 signature on the carrier envelope certificate is that of the voter.
1919 (b) Before deciding whether to accept or reject a timely
2020 delivered ballot under Section 87.027, the signature verification
2121 committee shall:
2222 (1) return the carrier envelope to the voter by mail,
2323 if the voter did not sign the carrier envelope certificate and the
2424 signature verification committee determines that it would be
2525 possible to sign and return the carrier envelope before the fifth
2626 day after election day; or
2727 (2) notify the voter of the defect by telephone or
2828 e-mail and inform the voter that the voter may come to the early
2929 voting clerk's office in person before the fifth day after election
3030 day to:
3131 (A) sign the carrier envelope certificate; or
3232 (B) affirm that the ballot was submitted by the
3333 voter.
3434 (c) A voter may not correct a defect under this section
3535 later than the fifth day after election day.
3636 (d) A poll watcher is entitled to observe an action taken
3737 under Subsection (b).
3838 (e) The secretary of state may prescribe any procedures
3939 necessary to implement this section.
4040 SECTION 2. Subchapter C, Chapter 87, Election Code, is
4141 amended by adding Section 87.0411 to read as follows:
4242 Sec. 87.0411. OPPORTUNITY TO CORRECT DEFECT: EARLY VOTING
4343 BALLOT BOARD. (a) This section applies to an early voting ballot
4444 voted by mail:
4545 (1) for which the voter did not sign the carrier
4646 envelope certificate; or
4747 (2) for which it cannot be determined whether the
4848 signature on the carrier envelope certificate is that of the voter.
4949 (b) Before deciding whether to accept or reject a timely
5050 delivered ballot under Section 87.041, the early voting ballot
5151 board shall:
5252 (1) return the carrier envelope to the voter by mail,
5353 if the voter did not sign the carrier envelope certificate and the
5454 early voting ballot board determines that it would be possible to
5555 sign and return the carrier envelope before the fifth day after
5656 election day; or
5757 (2) notify the voter of the defect by telephone or
5858 e-mail and inform the voter that the voter may come to the early
5959 voting clerk's office in person before the fifth day after election
6060 day to:
6161 (A) sign the carrier envelope certificate; or
6262 (B) affirm that the ballot was submitted by the
6363 voter.
6464 (c) A voter may not correct a defect under this section
6565 later than the fifth day after election day.
6666 (d) A poll watcher is entitled to observe an action taken
6767 under Subsection (b).
6868 (e) The secretary of state may prescribe any procedures
6969 necessary to implement this section.
7070 SECTION 3. Subchapter C, Chapter 87, Election Code, is
7171 amended by adding Section 87.045 to read as follows:
7272 Sec. 87.045. REJECTED BALLOT INFORMATION LIST. (a) The
7373 early voting ballot board for each election shall create a list of
7474 the voters whose ballots have been rejected. The list must include:
7575 (1) the voter's name;
7676 (2) the voter's address, unless the voter's residence
7777 address is confidential under Section 13.004(c);
7878 (3) the voter's unique identifier assigned under
7979 Section 18.061; and
8080 (4) the reason the voter's ballot was rejected.
8181 (b) The list created under Subsection (a) is a public record
8282 and shall be made available for public inspection.
8383 SECTION 4. This Act takes effect September 1, 2019.
