| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 1575.161, Insurance Code, is amended by |
|---|
| 11 | 11 | | adding Subsections (b) and (c) to read as follows: |
|---|
| 12 | 12 | | (b) Notwithstanding Subsection (a), the trustee by rule |
|---|
| 13 | 13 | | shall provide one opportunity to reenroll in a health benefit plan |
|---|
| 14 | 14 | | offered under the group program for an otherwise eligible retiree: |
|---|
| 15 | 15 | | (1) who is eligible to enroll in Medicare; |
|---|
| 16 | 16 | | (2) whose initial enrollment was voluntarily |
|---|
| 17 | 17 | | terminated on or after September 1, 2017, and on or before December |
|---|
| 18 | 18 | | 31, 2018; and |
|---|
| 19 | 19 | | (3) who opts to reenroll on or before December 31, |
|---|
| 20 | 20 | | 2023. |
|---|
| 21 | 21 | | (c) Subsection (b) and this subsection expire September 1, |
|---|
| 22 | 22 | | 2024. |
|---|
| 23 | 23 | | SECTION 2. (a) Not later than November 1, 2019, the Teacher |
|---|
| 24 | 24 | | Retirement System of Texas shall adopt rules necessary to implement |
|---|
| 25 | 25 | | Section 1575.161(b), Insurance Code, as added by this Act. |
|---|
| 26 | 26 | | (b) Rules adopted by the Teacher Retirement System of Texas |
|---|
| 27 | 27 | | under Section 1575.161(b), Insurance Code, as added by this Act, |
|---|
| 28 | 28 | | must apply to a retiree described by that subsection, regardless of |
|---|
| 29 | 29 | | whether the termination of the retiree's initial enrollment |
|---|
| 30 | 30 | | occurred before, on, or after the effective date of the rules or |
|---|
| 31 | 31 | | this Act. |
|---|
| 32 | 32 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 33 | 33 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 34 | 34 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 35 | 35 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 36 | 36 | | Act takes effect September 1, 2019. |
