| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Subchapter Z, Chapter 130, Local Government | |
| 11 | 11 | Code, is amended by adding Section 130.911 to read as follows: | |
| 12 | 12 | Sec. 130.911. COUNTY REFUND OF SMALL AMOUNT. A county is | |
| 13 | 13 | not required to refund an amount overpaid or otherwise paid in error | |
| 14 | 14 | to the county clerk by a person if: | |
| 15 | 15 | (1) that amount is $5 or less; | |
| 16 | 16 | (2) the county clerk notifies the person by mail of the | |
| 17 | 17 | amount overpaid or paid in error and includes with the notice a form | |
| 18 | 18 | for requesting a refund; and | |
| 19 | 19 | (3) the person fails to request a refund before the | |
| 20 | 20 | 90th day after the date the clerk mailed the notice. | |
| 21 | 21 | SECTION 2. This Act takes effect September 1, 2019. |
