6	8		AN ACT
7	9		relating to prescribing and dispensing certain controlled
8	10		substances to patients diagnosed with sickle cell disease.
9	11		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	12		SECTION 1. Sections 481.0765(a) and (b), Health and Safety
11	13		Code, are amended to read as follows:
12	14		(a) A prescriber is not subject to the requirements of
13	15		Section 481.0764(a) if:
14	16		(1) the patient has been diagnosed with cancer or
15	17		sickle cell disease or the patient is receiving hospice care; and
16	18		(2) the prescriber clearly notes in the prescription
17	19		record that the patient was diagnosed with cancer or sickle cell
18	20		disease or is receiving hospice care, as applicable.
19	21		(b) A dispenser is not subject to the requirements of
20	22		Section 481.0764(a) if it is clearly noted in the prescription
21	23		record that the patient has been diagnosed with cancer or sickle
22	24		cell disease or is receiving hospice care.
23	25		SECTION 2. The change in law made by this Act applies only
24	26		to a prescription issued on or after the effective date of this Act.
25	27		A prescription issued before the effective date of this Act is
26	28		governed by the law in effect on the date the prescription is
27	29		issued, and the former law is continued in effect for that purpose.
28	30		SECTION 3. This Act takes effect September 1, 2019.
