85 AN ACT
96 relating to the delegation by a podiatrist of certain acts to
107 certain podiatric assistants; authorizing fees.
118 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
129 SECTION 1. Subchapter H, Chapter 202, Occupations Code, is
1310 amended by adding Section 202.354 to read as follows:
1411 Sec. 202.354. DELEGATION OF CERTAIN ACTS. (a) A podiatrist
1512 may delegate to a qualified and properly trained podiatric medical
1613 assistant acting under the podiatrist's supervision any podiatric
1714 medical act that a reasonable and prudent podiatrist would find
1815 within the scope of sound medical judgment to delegate if:
1916 (1) in the opinion of the delegating podiatrist, the
2017 medical act:
2118 (A) can be properly and safely performed by the
2219 podiatric medical assistant to whom the podiatric medical act is
2320 delegated; and
2421 (B) is performed in a customary manner and not in
2522 violation of any other statute; and
2623 (2) the podiatric medical assistant to whom the
2724 podiatric medical act is delegated does not represent to the public
2825 that the medical assistant is authorized to practice podiatry.
2926 (b) A delegating podiatrist is responsible for a podiatric
3027 medical act performed by the podiatric medical assistant to whom
3128 the podiatrist delegates the act.
3229 SECTION 2. Subchapter D, Chapter 601, Occupations Code, is
3330 amended by adding Section 601.157 to read as follows:
3431 Sec. 601.157. PERSON SUPERVISED BY PODIATRIST. A person is
3532 not required to hold a certificate issued under this chapter to
3633 perform a radiologic procedure if:
3734 (1) the procedure is performed under the supervision
3835 of a podiatrist; and
3936 (2) the person:
4037 (A) is registered with the Texas Department of
4138 Licensing and Regulation to assist a podiatrist; and
4239 (B) complies with rules adopted under Section
4340 601.252(e).
4441 SECTION 3. Section 601.251, Occupations Code, is amended to
4542 read as follows:
4643 Sec. 601.251. APPLICABILITY. This subchapter applies to
4744 the:
4845 (1) Texas Board of Nursing;
4946 (2) Texas Board of Chiropractic Examiners;
5047 (3) State Board of Dental Examiners;
5148 (4) Texas Medical Board;
5249 (5) Texas Department of Licensing and Regulation, with
5350 respect to the department's authority to regulate podiatrists
5451 [State Board of Podiatric Medical Examiners]; and
5552 (6) Texas Physician Assistant Board.
5653 SECTION 4. Section 601.252, Occupations Code, is amended by
5754 adding Subsections (e) and (f) to read as follows:
5855 (e) Rules adopted under this section by the Texas Commission
5956 of Licensing and Regulation must:
6057 (1) require an authorized person who performs
6158 radiologic procedures under the delegation of a podiatrist, other
6259 than a registered nurse, to register with the Texas Department of
6360 Licensing and Regulation;
6461 (2) establish reasonable and necessary fees to cover
6562 the administrative costs incurred by the Texas Department of
6663 Licensing and Regulation in administering a registration program
6764 created under this subsection;
6865 (3) establish grounds for the suspension, revocation,
6966 or nonrenewal of a registration issued under this subsection; and
70- (4) establish standards for training and supervising
67+ (4) establish standards, for training and supervising
7168 the operators of the equipment.
7269 (f) In adopting rules under Subsection (e), the Texas
7370 Commission of Licensing and Regulation may take into account
7471 whether the radiologic procedure will be performed by a registered
7572 nurse.
7673 SECTION 5. To the extent of any conflict, this Act prevails
7774 over another Act of the 86th Legislature, Regular Session, 2019,
7875 relating to nonsubstantive additions to and corrections in enacted
7976 codes.
8077 SECTION 6. This Act takes effect September 1, 2019.
