66 AN ACT
77 relating to named driver policy disclosure requirements.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 1952.0545, Insurance Code, is amended by
1010 amending Subsections (b) and (c) and adding Subsection (c-1) to
1111 read as follows:
1212 (b) Before accepting any premium or fee at the inception or
1313 renewal of [for] a named driver policy, an agent or insurer,
1414 including a county mutual insurance company, must make the
1515 following disclosure, [orally and] in writing, to the applicant or
1616 insured:
1717 WARNING: A NAMED DRIVER POLICY DOES NOT PROVIDE COVERAGE FOR
1818 INDIVIDUALS RESIDING IN THE INSURED'S HOUSEHOLD THAT ARE NOT
1919 NAMED ON THE POLICY.
2020 (c) Before accepting any premium or fee at the inception or
2121 renewal of [for] a named driver policy, an agent or insurer,
2222 including a county mutual insurance company, must receive a copy of
2323 the disclosure described by Subsection (b) that is signed by the
2424 applicant or insured.
2525 (c-1) A signature required by this section must be an
2626 original signature or an electronic signature that complies with
2727 Chapter 322, Business & Commerce Code, and Chapter 35 of this code.
2828 SECTION 2. Section 1952.0545(e), Insurance Code, is
2929 repealed.
3030 SECTION 3. The change in law made by this Act applies only
3131 to an insurance policy that is delivered, issued for delivery, or
3232 renewed on or after January 1, 2020. A policy delivered, issued for
3333 delivery, or renewed before January 1, 2020, is governed by the law
3434 as it existed immediately before the effective date of this Act, and
3535 that law is continued in effect for that purpose.
3636 SECTION 4. This Act takes effect September 1, 2019.
