| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Section 2301.476, Occupations Code, is amended | |
| 11 | 11 | by adding Subsection (p) to read as follows: | |
| 12 | 12 | (p) A person who on January 1, 2018, held a manufacturer's | |
| 13 | 13 | license issued under this chapter may: | |
| 14 | 14 | (1) hold: | |
| 15 | 15 | (A) a manufacturer's license; | |
| 16 | 16 | (B) a general distinguishing number issued under | |
| 17 | 17 | Chapter 503, Transportation Code; and | |
| 18 | 18 | (C) one or more dealer's licenses; and | |
| 19 | 19 | (2) operate as both a manufacturer and dealer of motor | |
| 20 | 20 | vehicles to the extent the person: | |
| 21 | 21 | (A) manufactures only motor vehicles as defined | |
| 22 | 22 | by Section 2301.002(23)(C) and does not otherwise manufacture motor | |
| 23 | 23 | vehicles as defined by Section 2301.002(23); and | |
| 24 | 24 | (B) provides substantially equal access to any | |
| 25 | 25 | franchised dealer to all support for repairing a motor vehicle | |
| 26 | 26 | described by Paragraph (A), including access to: | |
| 27 | 27 | (i) parts and assemblies; | |
| 28 | 28 | (ii) training and technical service | |
| 29 | 29 | bulletins; and | |
| 30 | 30 | (iii) other repair information. | |
| 31 | 31 | SECTION 2. This Act takes effect September 1, 2019. |
