55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the operation of a motor vehicle dealership by certain
88 manufacturers.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 2301.476, Occupations Code, is amended
1111 by adding Subsection (p) to read as follows:
1212 (p) A person who on January 1, 2018, held a manufacturer's
1313 license issued under this chapter may:
1414 (1) hold:
1515 (A) a manufacturer's license;
1616 (B) a general distinguishing number issued under
1717 Chapter 503, Transportation Code; and
1818 (C) one or more dealer's licenses; and
1919 (2) operate as both a manufacturer and dealer of motor
2020 vehicles to the extent the person:
2121 (A) manufactures only motor vehicles as defined
2222 by Section 2301.002(23)(C) and does not otherwise manufacture motor
2323 vehicles as defined by Section 2301.002(23); and
2424 (B) provides substantially equal access to any
2525 franchised dealer to all support for repairing a motor vehicle
2626 described by Paragraph (A), including access to:
2727 (i) parts and assemblies;
2828 (ii) training and technical service
2929 bulletins; and
3030 (iii) other repair information.
3131 SECTION 2. This Act takes effect September 1, 2019.
