| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 111.185, Natural Resources Code, is |
|---|
| 11 | 11 | | amended to read as follows: |
|---|
| 12 | 12 | | Sec. 111.185. TEMPORARY RATES. Except as provided by |
|---|
| 13 | 13 | | Section 111.2211, if [If] a common carrier makes application or |
|---|
| 14 | 14 | | files a tariff to establish a new rate on either a new or old line, a |
|---|
| 15 | 15 | | temporary rate may be placed into effect immediately on filing the |
|---|
| 16 | 16 | | tariff with the commission. |
|---|
| 17 | 17 | | SECTION 2. Subchapter G, Chapter 111, Natural Resources |
|---|
| 18 | 18 | | Code, is amended by adding Section 111.2211 to read as follows: |
|---|
| 19 | 19 | | Sec. 111.2211. RATE COMPLAINTS. (a) If a complaint is filed |
|---|
| 20 | 20 | | with the commission about a rate charged by a person who owns, |
|---|
| 21 | 21 | | operates, or manages a pipeline or any part of a pipeline regulated |
|---|
| 22 | 22 | | under this chapter, the person who is the subject of the complaint |
|---|
| 23 | 23 | | may charge, until the date the commission makes a determination on |
|---|
| 24 | 24 | | the complaint, only a rate equal to or less than the rate preceding |
|---|
| 25 | 25 | | the rate that is the subject of the complaint. |
|---|
| 26 | 26 | | (b) The commission shall conduct a hearing and make a |
|---|
| 27 | 27 | | determination on the complaint not later than the 180th day after |
|---|
| 28 | 28 | | the date the complaint is filed. |
|---|
| 29 | 29 | | (c) If the commission determines that the complaint is |
|---|
| 30 | 30 | | invalid, the person who is the subject of the complaint is entitled |
|---|
| 31 | 31 | | to charge the finally determined proper rate for services provided |
|---|
| 32 | 32 | | after the date the complaint was filed. |
|---|
| 33 | 33 | | SECTION 3. The changes in law made by this Act apply only to |
|---|
| 34 | 34 | | a complaint filed with the Railroad Commission of Texas on or after |
|---|
| 35 | 35 | | the effective date of this Act. A complaint filed before the |
|---|
| 36 | 36 | | effective date of this Act is governed by the law in effect |
|---|
| 37 | 37 | | immediately before that date, and the former law is continued in |
|---|
| 38 | 38 | | effect for that purpose. |
|---|
| 39 | 39 | | SECTION 4. This Act takes effect September 1, 2019. |
