77 relating to complaints about rates charged by certain pipeline
88 operators.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 111.185, Natural Resources Code, is
1111 amended to read as follows:
1212 Sec. 111.185. TEMPORARY RATES. Except as provided by
1313 Section 111.2211, if [If] a common carrier makes application or
1414 files a tariff to establish a new rate on either a new or old line, a
1515 temporary rate may be placed into effect immediately on filing the
1616 tariff with the commission.
1717 SECTION 2. Subchapter G, Chapter 111, Natural Resources
1818 Code, is amended by adding Section 111.2211 to read as follows:
1919 Sec. 111.2211. RATE COMPLAINTS. (a) If a complaint is filed
2020 with the commission about a rate charged by a person who owns,
2121 operates, or manages a pipeline or any part of a pipeline regulated
2222 under this chapter, the person who is the subject of the complaint
2323 may charge, until the date the commission makes a determination on
2424 the complaint, only a rate equal to or less than the rate preceding
2525 the rate that is the subject of the complaint.
2626 (b) The commission shall conduct a hearing and make a
2727 determination on the complaint not later than the 180th day after
2828 the date the complaint is filed.
2929 (c) If the commission determines that the complaint is
3030 invalid, the person who is the subject of the complaint is entitled
3131 to charge the finally determined proper rate for services provided
3232 after the date the complaint was filed.
3333 SECTION 3. The changes in law made by this Act apply only to
3434 a complaint filed with the Railroad Commission of Texas on or after
3535 the effective date of this Act. A complaint filed before the
3636 effective date of this Act is governed by the law in effect
3737 immediately before that date, and the former law is continued in
3838 effect for that purpose.
3939 SECTION 4. This Act takes effect September 1, 2019.
