11 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 14 | | SECTION 1. Section 29.061, Education Code, is amended by |
---|
13 | 15 | | amending Subsections (b) and (b-1) and adding Subsection (b-3) to |
---|
14 | 16 | | read as follows: |
---|
15 | 17 | | (b) Except as provided by Subsection (b-3), a [A] teacher |
---|
16 | 18 | | assigned to a bilingual education program using one of the |
---|
17 | 19 | | following program models must be appropriately certified for |
---|
18 | 20 | | bilingual education by the board: |
---|
19 | 21 | | (1) transitional bilingual/early exit program model; |
---|
20 | 22 | | or |
---|
21 | 23 | | (2) transitional bilingual/late exit program model. |
---|
22 | 24 | | (b-1) Except as provided by Subsection (b-3), a [A] teacher |
---|
23 | 25 | | assigned to a bilingual education program using a dual language |
---|
24 | 26 | | immersion/one-way or two-way program model must be appropriately |
---|
25 | 27 | | certified by the board for: |
---|
26 | 28 | | (1) bilingual education for the component of the |
---|
27 | 29 | | program provided in a language other than English; and |
---|
28 | 30 | | (2) bilingual education or English as a second |
---|
29 | 31 | | language for the component of the program provided in English. |
---|
30 | 32 | | (b-3) A school district may assign to any bilingual |
---|
31 | 33 | | education program a teacher certified for English as a second |
---|
32 | 34 | | language for a school year if: |
---|
33 | 35 | | (1) the commissioner has determined that there is a |
---|
34 | 36 | | shortage of teachers certified for bilingual education by the board |
---|
35 | 37 | | for the school year; and |
---|
36 | 38 | | (2) a teacher certified for bilingual education is not |
---|
37 | 39 | | reasonably available to the district. |
---|
38 | 40 | | SECTION 2. Section 42.153(c), Education Code, is amended to |
---|
39 | 41 | | read as follows: |
---|
40 | 42 | | (c) A district's bilingual education or special language |
---|
41 | 43 | | allocation may be used only for: |
---|
42 | 44 | | (1) program and student evaluation;[,] |
---|
43 | 45 | | (2) instructional materials and equipment;[,] |
---|
44 | 46 | | (3) staff development, including assisting a teacher |
---|
45 | 47 | | employed by the district in obtaining certification under Section |
---|
46 | 48 | | 29.061; |
---|
47 | 49 | | (4) supplemental staff expenses;[,] |
---|
48 | 50 | | (5) salary supplements for teachers;[,] and |
---|
49 | 51 | | (6) other supplies required for quality instruction |
---|
50 | 52 | | and smaller class size. |
---|
51 | 53 | | SECTION 3. This Act applies beginning with the 2019-2020 |
---|
52 | 54 | | school year. |
---|
53 | 55 | | SECTION 4. This Act takes effect immediately if it receives |
---|
54 | 56 | | a vote of two-thirds of all the members elected to each house, as |
---|
55 | 57 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
56 | 58 | | Act does not receive the vote necessary for immediate effect, this |
---|
57 | 59 | | Act takes effect September 1, 2019. |
