119 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1210 SECTION 1. Chapter 32, Health and Safety Code, is amended by
1311 adding Subchapter E to read as follows:
14- SUBCHAPTER E. MATERNAL MENTAL HEALTH PEER SUPPORT PILOT PROGRAM
15- Sec. 32.101. DEFINITIONS. In this subchapter:
16- (1) "Peer support service" means a service provided by
17- a peer support specialist to a person with mental illness or
18- substance abuse conditions in accordance with commission rules
19- regarding peer specialists.
20- (2) "Perinatal mood and anxiety disorder" includes any
21- of the following psychiatric illnesses, as defined by the American
22- Psychiatric Association in the Diagnostic and Statistical Manual
23- (DSM), that occur during pregnancy or within 12 months postpartum:
24- (A) bipolar disorder, including hypomanic,
25- manic, depressive, and mixed types;
26- (B) major depressive disorder, including
27- single-episode and recurrent types;
28- (C) generalized anxiety disorder;
29- (D) obsessive-compulsive disorder;
30- (E) paranoid or other psychotic disorder; and
31- (F) post-traumatic stress disorder.
32- (3) "Pilot program" means the maternal mental health
33- peer support pilot program established under this subchapter.
12+ SUBCHAPTER E. MATERNAL PEER SUPPORT PILOT PROGRAM
13+ Sec. 32.101. DEFINITION. In this subchapter, "pilot
14+ program" means the maternal peer support pilot program established
15+ under this subchapter.
3416 Sec. 32.102. ESTABLISHMENT OF PILOT PROGRAM. (a) The
35- commission shall establish and operate the maternal mental health
36- peer support pilot program to reduce the risk and manage the effects
37- of perinatal mood and anxiety disorders in women through the
38- delivery of peer support services at federally qualified health
39- centers located in the geographic areas in which the pilot program
40- operates.
41- (b) The commission shall establish the pilot program in five
42- counties in this state that:
17+ commission shall establish and operate the maternal peer support
18+ pilot program to reduce the risk and manage the effects of perinatal
19+ mood disorders in women through the delivery of peer support
20+ services at federally qualified health centers located in the
21+ geographic areas in which the pilot program operates.
22+ (b) The commission shall establish the pilot program in
23+ three counties in this state that:
4324 (1) either:
4425 (A) are within an area designated as a mental
4526 health professional shortage area; or
4627 (B) have high rates of maternal mortality and
4728 morbidity as determined by the commission in consultation with the
4829 Maternal Mortality and Morbidity Task Force established under
4930 Chapter 34; and
5031 (2) include at least one rural county and one county
51- with a population of at least 500,000.
32+ with a population of at least one million.
5233 Sec. 32.103. OPERATION OF PILOT PROGRAM. (a) In
5334 establishing the pilot program, the commission shall:
5435 (1) develop a strategy for federally qualified health
5536 centers participating in the pilot program and persons responsible
5637 for training to collaborate on the training, certification, and
57- guidance of peer support specialists in accordance with existing
58- state procedures and programs;
38+ guidance of peer support specialists;
5939 (2) seek comments regarding best practices for the
6040 design and implementation of the pilot program from relevant
61- interested persons, including federally qualified health centers,
62- mental health care providers, local mental health authorities,
63- certified peer support specialists and affiliated organizations,
64- women's health care providers, and individuals who have personal
65- experience with perinatal mood and anxiety disorders;
41+ interested persons, including mental health care providers, local
42+ mental health authorities, certified peer support specialists and
43+ affiliated organizations, women's health care providers, and
44+ individuals who have personal experience with perinatal mood
45+ disorders;
6646 (3) develop specialized training to:
6747 (A) identify and treat symptoms of perinatal mood
68- and anxiety disorders; and
48+ disorders; and
6949 (B) provide peer support services to pregnant
7050 women and new mothers;
71- (4) develop a strategy for federally qualified health
72- centers and peer support specialists participating in the pilot
73- program to provide peer support services through any form of
74- telephonic communication;
75- (5) develop a strategy with federally qualified health
51+ (4) develop a strategy for peer support specialists
52+ participating in the pilot program to provide peer support services
53+ through telemedicine or telehealth services;
54+ (5) collaborate with federally qualified health
7655 centers participating in the pilot program to integrate the
7756 delivery of peer support services with the health care services
7857 provided by the centers to women during pregnancy and within one
7958 year of giving birth;
80- (6) create a protocol within federally qualified
81- health centers participating in the pilot program for referring to
82- peer support services women who are diagnosed as having or
83- identified as being at risk of developing a perinatal mood and
84- anxiety disorder;
59+ (6) create a protocol for referring to peer support
60+ services women who are diagnosed as having or identified as being at
61+ risk of developing a perinatal mood disorder;
8562 (7) ensure that services provided by peer support
86- specialists under the pilot program are within the scope of a duty
87- of care prescribed by commission rule for peer support specialists
88- who provide similar services; and
89- (8) develop a method for collecting data, including by
90- consulting with the Maternal Mortality and Morbidity Task Force and
91- other relevant entities regarding the data, on:
63+ specialists under the pilot program are within the scope of a
64+ practice of care prescribed by commission rule for peer support
65+ specialists who provide similar services; and
66+ (8) develop a method for collecting data on:
9267 (A) maternal health and mental health outcomes;
9368 and
9469 (B) substance use by women receiving peer support
9570 services through the pilot program.
9671 (b) A peer support specialist who provides peer support
97- services through the pilot program at a federally qualified health
98- center shall:
72+ services through the pilot program shall:
9973 (1) provide peer support services to women who:
10074 (A) based on the results of a postpartum
10175 depression screening or other screening tool, are diagnosed as
10276 having or identified as being at risk of developing a perinatal mood
103- and anxiety disorder; and
77+ disorder; and
10478 (B) are interested in receiving peer support
10579 services; and
10680 (2) through the use of the specialist's personal
107- experience with perinatal mood and anxiety disorders:
81+ experience with perinatal mood disorders:
10882 (A) provide guidance to the women;
10983 (B) if necessary, advocate for the women to
11084 receive mental health care services or other specialized health
11185 care services; and
11286 (C) provide the women with information on mental
11387 health care resources as necessary.
11488 Sec. 32.104. FUNDING. In addition to money appropriated by
11589 the legislature, the commission may accept gifts, grants, and
11690 donations from any source for the purpose of establishing the pilot
11791 program and compensating peer support specialists under the pilot
11892 program.
11993 Sec. 32.105. REPORT. Not later than January 1, 2021, the
12094 commission shall prepare and submit to the governor, lieutenant
12195 governor, and legislature a written report that:
12296 (1) evaluates the success of the pilot program in
123- reducing perinatal mood and anxiety disorders and substance use in
124- women who received peer support services under the pilot program;
125- and
97+ reducing perinatal mood disorders and substance use in women who
98+ received peer support services under the pilot program; and
12699 (2) recommends whether the pilot program should be
127100 continued, expanded, or terminated.
128- Sec. 32.106. EXPIRATION. This subchapter expires September
129- 1, 2023.

130103 SECTION 2. (a) Not later than December 31, 2019, the
131104 executive commissioner of the Health and Human Services Commission
132105 shall adopt rules as necessary to establish the pilot program as
133106 required by Subchapter E, Chapter 32, Health and Safety Code, as
134107 added by this Act.
135- (b) Not later than June 30, 2020, the Health and Human
