4	10		AN ACT
5	11		relating to the requirements for a change of name for a person with
6	12		a final felony conviction or a person required to register as a sex
7	13		offender.
8	14		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
9	15		SECTION 1. Section 45.103, Family Code, is amended by
10	16		amending Subsections (b) and (c) and adding Subsection (d) to read
11	17		as follows:
12	18		(b) A court may order a change of name under this subchapter
13	19		for a person with a final felony conviction if:
14	20		(1) [,] in addition to the requirements of Subsection
15	21		(a), the person has:
16	22		(A) [(1)] received a certificate of discharge by
17	23		the Texas Department of Criminal Justice or completed a period of
18	24		community supervision or juvenile probation ordered by a court and
19	25		not less than two years have passed from the date of the receipt of
20	26		discharge or completion of community supervision or juvenile
21	27		probation; or
22	28		(B) [(2)] been pardoned; or
23	29		(2) the person is requesting to change the person's
24	30		name to the primary name used in the person's criminal history
25	31		record information.
26	32		(c) A court may order a change of name under this subchapter
27	33		for a person subject to the registration requirements of Chapter
28	34		62, Code of Criminal Procedure, if the person:
29	35		(1) meets [, in addition to] the requirements of
30	36		Subsection (a) or is requesting to change the person's name to the
31	37		primary name used in the person's criminal history record
32	38		information; and
33	39		(2) [, the person] provides the court with proof that
34	40		the person has notified the appropriate local law enforcement
35	41		authority of the proposed name change.
36	42		(d) In this section:
37	43		(1) "Criminal history record information" has the
38	44		meaning assigned by Section 411.082, Government Code.
39	45		(2) "Local [subsection, "local] law enforcement
40	46		authority" has the meaning assigned by Article 62.001, Code of
41	47		Criminal Procedure.
42	48		SECTION 2. Section 45.103, Family Code, as amended by this
43	49		Act, applies only to a petition for a change of name that is filed on
44	50		or after the effective date of this Act. A petition filed before
45	51		the effective date of this Act is governed by the law in effect on
46	52		the date the petition was filed, and the former law is continued in
47	53		effect for that purpose.
48	54		SECTION 3. This Act takes effect September 1, 2019.
