89 relating to notice by certain managed care entities of changes
910 related to reimbursements applicable to certain physicians and
1011 health care providers.
1112 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1213 SECTION 1. Section 843.321, Insurance Code, is amended by
1314 adding Subsection (a-1) to read as follows:
1415 (a-1) A health maintenance organization or health
1516 maintenance organization's agent that provides a notice under
1617 Subsection (a)(3) must provide the notice to a physician or
1718 provider, including a licensed clinical social worker, in a manner
1819 that is trackable and indicates the date and time the notice was
1920 sent, including:
2021 (1) by certified mail, return receipt requested, to
2122 the physician's or provider's address; or
2223 (2) by e-mail to an e-mail address specified by the
2324 physician or provider.
2425 SECTION 2. Section 1301.136, Insurance Code, is amended by
2526 adding Subsection (a-1) to read as follows:
2627 (a-1) An insurer or insurer's agent that provides a notice
2728 under Subsection (a)(3) must provide the notice to a preferred
2829 provider, including a licensed clinical social worker, in a manner
2930 that is trackable and indicates the date and time the notice was
3031 sent, including:
3132 (1) by certified mail, return receipt requested, to
3233 the preferred provider's address; or
3334 (2) by e-mail to an e-mail address specified by the
3435 preferred provider.
3536 SECTION 3. The heading to Chapter 1453, Insurance Code, is
3637 amended to read as follows:

3940 SECTION 4. Section 1453.001(1), Insurance Code, is amended
4041 to read as follows:
4142 (1) "Health care provider" means:
4243 (A) a hospital, emergency clinic, outpatient
4344 clinic, or other facility providing health care services; or
4445 (B) an individual who is licensed in this state
4546 to provide health care services, including a physician who is
4647 licensed to practice medicine in this state.
4748 SECTION 5. Chapter 1453, Insurance Code, is amended by
4849 adding Section 1453.004 to read as follows:
4950 Sec. 1453.004. NOTICE OF CHANGE TO REIMBURSEMENT AMOUNT.
5051 (a) A managed care entity shall provide to each health care
5152 provider, including a licensed clinical social worker, under
5253 contract with the managed care entity notice of any change to a
5354 reimbursement amount that will be paid to the health care provider
5455 for a good or service provided by the health care provider. The
5556 notice must be provided before the effective date of the change.
5657 (b) The notice required by this section must be sent:
5758 (1) directly to each health care provider that may be
5859 affected by the reimbursement amount change; and
5960 (2) in a manner that is trackable and indicates the
6061 date and time the notice was sent, including:
6162 (A) by certified mail, return receipt requested,
6263 to the provider's address; or
6364 (B) by e-mail to an e-mail address specified by
6465 the provider.
6566 SECTION 6. This Act takes effect September 1, 2019.
