9+ A BILL TO BE ENTITLED
410 AN ACT
511 relating to municipal boundaries used to determine a cemetery
612 location.
713 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
814 SECTION 1. Section 711.008(e), Health and Safety Code, is
915 amended to read as follows:
1016 (e) For the purpose of determining where a cemetery may be
1117 located under Subsection (a), the boundary of an area annexed by a
1218 municipality is not considered to be a boundary of the municipality
1319 if:
1420 (1) no more than 10 percent of the boundary of the
1521 annexed area is composed of a part of the boundary of the annexing
1622 municipality as it existed immediately before the annexation; or
1723 (2) the annexed area cannot be developed as
1824 residential or commercial property and is primarily used for flood
1925 control.
2026 SECTION 2. This Act takes effect September 1, 2019.
