66 AN ACT
77 relating to the amount of the fee paid by a defendant for a peace
88 officer's services in executing or processing an arrest warrant,
99 capias, or capias pro fine.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Article 102.011(a), Code of Criminal Procedure,
1212 is amended to read as follows:
1313 (a) A defendant convicted of a felony or a misdemeanor shall
1414 pay the following fees for services performed in the case by a peace
1515 officer:
1616 (1) $5 for issuing a written notice to appear in court
1717 following the defendant's violation of a traffic law, municipal
1818 ordinance, or penal law of this state, or for making an arrest
1919 without a warrant;
2020 (2) $75 [$50] for executing or processing an issued
2121 arrest warrant, capias, or capias pro fine with the fee imposed for
2222 the services of:
2323 (A) the law enforcement agency that executed the
2424 arrest warrant or capias, if the agency requests of the court, not
2525 later than the 15th day after the date of the execution of the
2626 arrest warrant or capias, the imposition of the fee on conviction;
2727 or
2828 (B) the law enforcement agency that processed the
2929 arrest warrant or capias, if:
3030 (i) the arrest warrant or capias was not
3131 executed; or
3232 (ii) the executing law enforcement agency
3333 failed to request the fee within the period required by Paragraph
3434 (A) [of this subdivision];
3535 (3) $5 for summoning a witness;
3636 (4) $35 for serving a writ not otherwise listed in this
3737 article;
3838 (5) $10 for taking and approving a bond and, if
3939 necessary, returning the bond to the courthouse;
4040 (6) $5 for commitment or release;
4141 (7) $5 for summoning a jury, if a jury is summoned; and
4242 (8) $8 for each day's attendance of a prisoner in a
4343 habeas corpus case if the prisoner has been remanded to custody or
4444 held to bail.
4545 SECTION 2. Section 102.021, Government Code, is amended to
4646 read as follows:
4747 Sec. 102.021. COURT COSTS ON CONVICTION: CODE OF CRIMINAL
4848 PROCEDURE. A person convicted of an offense shall pay the following
4949 under the Code of Criminal Procedure, in addition to all other
5050 costs:
5151 (1) court cost on conviction of any offense, other
5252 than a conviction of an offense relating to a pedestrian or the
5353 parking of a motor vehicle (Art. 102.0045, Code of Criminal
5454 Procedure) . . . $4;
5555 (2) a fee for services of prosecutor (Art. 102.008,

129129 SECTION 3. The change in law made by this Act applies only
130130 to a fee imposed for the execution or processing of a warrant,
131131 capias, or capias pro fine issued for an offense committed on or
132132 after the effective date of this Act. A fee imposed for the
133133 execution or processing of a warrant, capias, or capias pro fine
134134 issued for an offense committed before the effective date of this
135135 Act is governed by the law in effect on the date the offense was
136136 committed, and the former law is continued in effect for that
137137 purpose. For purposes of this section, an offense was committed
138138 before the effective date of this Act if any element of the offense
139139 occurred before that date.
140140 SECTION 4. This Act takes effect September 1, 2019.
