| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Title 5, Water Code, is amended by designating |
|---|
| 11 | 11 | | Chapter 152 as Subtitle A and adding a subtitle heading to read as |
|---|
| 12 | 12 | | follows: |
|---|
| 13 | 13 | | SUBTITLE A. RIVER AUTHORITIES |
|---|
| 14 | 14 | | SECTION 2. Subtitle A, Title 5, Water Code, as added by this |
|---|
| 15 | 15 | | Act, is amended by adding Chapter 150 to read as follows: |

| 16 | 16 | | CHAPTER 150. PROVISIONS GENERALLY APPLICABLE TO RIVER AUTHORITIES |
|---|
| 17 | 17 | | Sec. 150.0001. DEFINITIONS. In this chapter: |
|---|
| 18 | 18 | | (1) "Board" means the board of directors of a river |
|---|
| 19 | 19 | | authority. |
|---|
| 20 | 20 | | (2) "River authority" means a district created under |
|---|
| 21 | 21 | | the authority of Section 59, Article XVI, Texas Constitution, as a |
|---|
| 22 | 22 | | regional water management entity to provide water development and |
|---|
| 23 | 23 | | planning services and other services to a river basin or portion of |
|---|
| 24 | 24 | | a river basin. |
|---|
| 25 | 25 | | Sec. 150.0002. PRESIDING OFFICER. The governor shall |
|---|
| 26 | 26 | | designate a member of the board of a river authority as the |
|---|
| 27 | 27 | | presiding officer of the board to serve in that capacity at the |
|---|
| 28 | 28 | | pleasure of the governor. |
|---|
| 29 | 29 | | SECTION 3. (a) In this section, "river authority" means a |
|---|
| 30 | 30 | | district created under the authority of Section 59, Article XVI, |
|---|
| 31 | 31 | | Texas Constitution, as a regional water management entity to |
|---|
| 32 | 32 | | provide water development and planning services and other services |
|---|
| 33 | 33 | | to a river basin or portion of a river basin. |
|---|
| 34 | 34 | | (b) For each river authority for which the governor was not |
|---|
| 35 | 35 | | required to designate a presiding officer of the board of directors |
|---|
| 36 | 36 | | for that river authority before the effective date of this Act, the |
|---|
| 37 | 37 | | governor shall designate a presiding officer of the board of |
|---|
| 38 | 38 | | directors of the river authority not later than January 31, 2020. |

| 39 | 39 | | SECTION 4. This Act takes effect September 1, 2019. |
