66 AN ACT
77 relating to the presiding officers of the boards of directors of
88 river authorities.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Title 5, Water Code, is amended by designating
1111 Chapter 152 as Subtitle A and adding a subtitle heading to read as
1212 follows:
1313 SUBTITLE A. RIVER AUTHORITIES
1414 SECTION 2. Subtitle A, Title 5, Water Code, as added by this
1515 Act, is amended by adding Chapter 150 to read as follows:
1616 CHAPTER 150. PROVISIONS GENERALLY APPLICABLE TO RIVER AUTHORITIES
1717 Sec. 150.0001. DEFINITIONS. In this chapter:
1818 (1) "Board" means the board of directors of a river
1919 authority.
2020 (2) "River authority" means a district created under
2121 the authority of Section 59, Article XVI, Texas Constitution, as a
2222 regional water management entity to provide water development and
2323 planning services and other services to a river basin or portion of
2424 a river basin.
2525 Sec. 150.0002. PRESIDING OFFICER. The governor shall
2626 designate a member of the board of a river authority as the
2727 presiding officer of the board to serve in that capacity at the
2828 pleasure of the governor.
2929 SECTION 3. (a) In this section, "river authority" means a
3030 district created under the authority of Section 59, Article XVI,
3131 Texas Constitution, as a regional water management entity to
3232 provide water development and planning services and other services
3333 to a river basin or portion of a river basin.
3434 (b) For each river authority for which the governor was not
3535 required to designate a presiding officer of the board of directors
3636 for that river authority before the effective date of this Act, the
3737 governor shall designate a presiding officer of the board of
3838 directors of the river authority not later than January 31, 2020.
3939 SECTION 4. This Act takes effect September 1, 2019.
