| 7 | 7 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 8 | 8 | SECTION 1. Section 42.005, education code, is amended by | |
| 9 | 9 | adding Subsection (o): | |
| 10 | 10 | (o) for grade levels kindergarten, first, second, third, | |
| 11 | 11 | fourth, and fifth grade, average daily attendance is equivalent to | |
| 12 | 12 | the final enrollment number submitted by each Local Education | |
| 13 | 13 | Agency to the Public Education Information Management System | |
| 14 | 14 | annually. | |
| 15 | 15 | SECTION 2. This Act applies beginning with the 2019-2020 | |
| 16 | 16 | school year. | |
| 17 | 17 | SECTION 3. This Act takes effect immediately if it receives | |
| 18 | 18 | a vote of two-thirds of all the members elected to each house, as | |
| 19 | 19 | provided by Section 39, Article III, Texas Constitution. If this | |
| 20 | 20 | Act does not receive the vote necessary for immediate effect, this | |
| 21 | 21 | Act takes effect September 1, 2019. |
