7 | 7 | | relating to the compilation and reporting of statistics involving |

8 | 8 | | sexual assault victims who receive a forensic medical examination |
---|
9 | 9 | | before reporting the assault to law enforcement. |

10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 11 | | SECTION 1. Subchapter A, Chapter 56, Code of Criminal |
---|
12 | 12 | | Procedure, is amended by adding Article 56.0651 to read as follows: |
---|
13 | 13 | | Art. 56.0651. DELAYED REPORTING BY SEXUAL ASSAULT VICTIMS; |
---|
14 | 14 | | COMPILATION OF STATISTICS. (a) In this article, "department" |
---|
15 | 15 | | means the Department of Public Safety. |
---|
16 | 16 | | (b) The department shall compile and maintain statistics on |
---|
17 | 17 | | the number of victims of sexual assault in each calendar year who |
---|
18 | 18 | | have reported the sexual assault to a law enforcement agency after |
---|
19 | 19 | | receiving a forensic medical examination under Article 56.065, |
---|
20 | 20 | | regardless of the year in which that examination was performed. |
---|
21 | 21 | | Statistics compiled and maintained under this subsection may not |
---|
22 | 22 | | include identifying information of a victim. |
---|
23 | 23 | | (c) Not later than September 1 of each even-numbered year, |
---|
24 | 24 | | the department shall: |
---|
25 | 25 | | (1) report the statistics compiled by the department |
---|
26 | 26 | | under Subsection (b) to the standing committees of the house of |
---|
27 | 27 | | representatives and senate with primary jurisdiction over criminal |
---|
28 | 28 | | justice issues; and |
---|
29 | 29 | | (2) post the statistics compiled by the department |
---|
30 | 30 | | under Subsection (b) on the department's Internet website. |
---|
31 | 31 | | SECTION 2. This Act takes effect September 1, 2019. |
