7 | 7 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
8 | 8 | SECTION 1. Section 42.155, Education Code, Subsection (g) | |
9 | 9 | is amended to read as follows: | |
10 | 10 | (g) A school district or county that provides special | |
11 | 11 | transportation services for eligible special education students or | |
12 | 12 | homeless students as defined by 42 U.S.C. Section 11302 is entitled | |
13 | 13 | to a state allocation paid on a previous year's cost-per-mile | |
14 | 14 | basis. The maximum rate per mile allowable shall be set by | |
15 | 15 | appropriation based on data gathered from the first year of each | |
16 | 16 | preceding biennium. Districts may use a portion of their support | |
17 | 17 | allocation to pay transportation costs, if necessary. The | |
18 | 18 | commissioner may grant an amount set by appropriation for private | |
19 | 19 | transportation to reimburse parents or their agents for | |
20 | 20 | transporting eligible special education students. The mileage | |
21 | 21 | allowed shall be computed along the shortest public road from the | |
22 | 22 | student's home to school and back, morning and afternoon. The need | |
23 | 23 | for this type transportation shall be determined on an individual | |
24 | 24 | basis and shall be approved only in extreme hardship cases. | |
25 | 25 | SECTION 2. This Act takes effect September 1, 2019. |
