66 relating to transportation services for homeless students.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 42.155, Education Code, Subsection (g)
99 is amended to read as follows:
1010 (g) A school district or county that provides special
1111 transportation services for eligible special education students or
1212 homeless students as defined by 42 U.S.C. Section 11302 is entitled
1313 to a state allocation paid on a previous year's cost-per-mile
1414 basis. The maximum rate per mile allowable shall be set by
1515 appropriation based on data gathered from the first year of each
1616 preceding biennium. Districts may use a portion of their support
1717 allocation to pay transportation costs, if necessary. The
1818 commissioner may grant an amount set by appropriation for private
1919 transportation to reimburse parents or their agents for
2020 transporting eligible special education students. The mileage
2121 allowed shall be computed along the shortest public road from the
2222 student's home to school and back, morning and afternoon. The need
2323 for this type transportation shall be determined on an individual
2424 basis and shall be approved only in extreme hardship cases.
2525 SECTION 2. This Act takes effect September 1, 2019.
