| 8 | 8 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 9 | 9 | SECTION 1. Section 545.157(a), Transportation Code, is | |
| 10 | 10 | amended to read as follows: | |
| 11 | 11 | (a) This section applies only to the following vehicles: | |
| 12 | 12 | (1) a stationary authorized emergency vehicle using | |
| 13 | 13 | visual signals that meet the requirements of Sections 547.305 and | |
| 14 | 14 | 547.702; | |
| 15 | 15 | (2) a stationary tow truck using equipment authorized | |
| 16 | 16 | by Section 547.305(d); [and] | |
| 17 | 17 | (3) a Texas Department of Transportation vehicle not | |
| 18 | 18 | separated from the roadway by a traffic control channelizing device | |
| 19 | 19 | and using visual signals that comply with the standards and | |
| 20 | 20 | specifications adopted under Section 547.105; and | |
| 21 | 21 | (4) a stationary utility maintenance vehicle not | |
| 22 | 22 | separated from the roadway by a traffic control channelizing device | |
| 23 | 23 | and using flashing amber or blue lights. | |
| 24 | 24 | SECTION 2. Section 545.157(e), Transportation Code, is | |
| 25 | 25 | amended by adding Subdivision (3) to read as follows: | |
| 26 | 26 | (3) "Utility maintenance vehicle" means a motor | |
| 27 | 27 | vehicle operated by or for a utility, as defined by Section 203.091. | |
| 28 | 28 | SECTION 3. This Act takes effect September 1, 2019. |
