55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the offense of passing certain vehicles on a highway.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 545.157(a), Transportation Code, is
1010 amended to read as follows:
1111 (a) This section applies only to the following vehicles:
1212 (1) a stationary authorized emergency vehicle using
1313 visual signals that meet the requirements of Sections 547.305 and
1414 547.702;
1515 (2) a stationary tow truck using equipment authorized
1616 by Section 547.305(d); [and]
1717 (3) a Texas Department of Transportation vehicle not
1818 separated from the roadway by a traffic control channelizing device
1919 and using visual signals that comply with the standards and
2020 specifications adopted under Section 547.105; and
2121 (4) a stationary utility maintenance vehicle not
2222 separated from the roadway by a traffic control channelizing device
2323 and using flashing amber or blue lights.
2424 SECTION 2. Section 545.157(e), Transportation Code, is
2525 amended by adding Subdivision (3) to read as follows:
2626 (3) "Utility maintenance vehicle" means a motor
2727 vehicle operated by or for a utility, as defined by Section 203.091.
2828 SECTION 3. This Act takes effect September 1, 2019.
