8 | 8 | | officer, an honorably retired peace officer, or a survivor of a |

9 | 9 | | deceased peace officer. |

10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 11 | | SECTION 1. Chapter 614, Government Code, is amended by |
---|
12 | 12 | | adding Subchapter L to read as follows: |
---|
13 | 13 | | SUBCHAPTER L. TRANSFER OF LAW ENFORCEMENT DOG TO PEACE OFFICER, |
---|
14 | 14 | | HONORABLY RETIRED PEACE OFFICER, OR SURVIVOR OF DECEASED PEACE |
---|
15 | 15 | | OFFICER |
---|
16 | 16 | | Sec. 614.221. DEFINITIONS. In this subchapter: |
---|
17 | 17 | | (1) "Governmental entity" means a state agency or a |
---|
18 | 18 | | political subdivision, including a county, municipality, school |
---|
19 | 19 | | district, special district, or joint board created under Section |
---|
20 | 20 | | 22.074, Transportation Code. |
---|
21 | 21 | | (2) "Law enforcement dog" means a dog owned by a |
---|
22 | 22 | | governmental entity that is assigned to a peace officer for law |
---|
23 | 23 | | enforcement purposes. |
---|
24 | 24 | | Sec. 614.222. COMPETITIVE BIDDING PROVISIONS INAPPLICABLE. |
---|
25 | 25 | | A transfer authorized under this subchapter is not subject to |
---|
26 | 26 | | competitive bidding, salvage property disposition, or similar |
---|
27 | 27 | | requirements that would otherwise be applicable to the transfer. |
---|
28 | 28 | | Sec. 614.223. TRANSFER OF RETIRED LAW ENFORCEMENT DOG TO |
---|
29 | 29 | | PEACE OFFICER. At the request of a peace officer who is the handler |
---|
30 | 30 | | of a law enforcement dog that is to be retired from service, the |
---|
31 | 31 | | governmental entity that owns the dog shall transfer ownership of |
---|
32 | 32 | | the dog to the peace officer. |
---|
33 | 33 | | Sec. 614.224. PURCHASE OF LAW ENFORCEMENT DOG BY HONORABLY |
---|
34 | 34 | | RETIRED PEACE OFFICER. On the request of a peace officer who |
---|
35 | 35 | | retires honorably and who has been the handler of a law enforcement |
---|
36 | 36 | | dog, a governmental entity shall allow the peace officer to |
---|
37 | 37 | | purchase the dog. |
---|
38 | 38 | | Sec. 614.225. PURCHASE OF LAW ENFORCEMENT DOG BY SURVIVING |
---|
39 | 39 | | SPOUSE, CHILD, OR PARENT OF DECEASED PEACE OFFICER. (a) For a law |
---|
40 | 40 | | enforcement dog whose handler died while commissioned, the |
---|
41 | 41 | | governmental entity that owns the dog may sell the dog to, in order |
---|
42 | 42 | | of priority: |
---|
43 | 43 | | (1) the surviving spouse of the deceased peace |
---|
44 | 44 | | officer; |
---|
45 | 45 | | (2) a child of the deceased peace officer; and |
---|
46 | 46 | | (3) a parent of the deceased peace officer. |
---|
47 | 47 | | (b) The governmental entity may sell a dog under Subsection |
---|
48 | 48 | | (a) regardless of whether the officer died while discharging the |
---|
49 | 49 | | officer's official duties. |
---|
50 | 50 | | Sec. 614.226. PURCHASE PRICE OF LAW ENFORCEMENT DOG. A |
---|
51 | 51 | | governmental entity shall establish the amount for which a law |
---|
52 | 52 | | enforcement dog may be purchased under this subchapter, which may |
---|
53 | 53 | | not exceed fair market value. |
---|
54 | 54 | | SECTION 2. This Act takes effect September 1, 2019. |
---|
