66 AN ACT
77 relating to the transfer or sale of a law enforcement dog to a peace
88 officer, an honorably retired peace officer, or a survivor of a
99 deceased peace officer.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Chapter 614, Government Code, is amended by
1212 adding Subchapter L to read as follows:
1313 SUBCHAPTER L. TRANSFER OF LAW ENFORCEMENT DOG TO PEACE OFFICER,
1414 HONORABLY RETIRED PEACE OFFICER, OR SURVIVOR OF DECEASED PEACE
1515 OFFICER
1616 Sec. 614.221. DEFINITIONS. In this subchapter:
1717 (1) "Governmental entity" means a state agency or a
1818 political subdivision, including a county, municipality, school
1919 district, special district, or joint board created under Section
2020 22.074, Transportation Code.
2121 (2) "Law enforcement dog" means a dog owned by a
2222 governmental entity that is assigned to a peace officer for law
2323 enforcement purposes.
2424 Sec. 614.222. COMPETITIVE BIDDING PROVISIONS INAPPLICABLE.
2525 A transfer authorized under this subchapter is not subject to
2626 competitive bidding, salvage property disposition, or similar
2727 requirements that would otherwise be applicable to the transfer.
2828 Sec. 614.223. TRANSFER OF RETIRED LAW ENFORCEMENT DOG TO
2929 PEACE OFFICER. At the request of a peace officer who is the handler
3030 of a law enforcement dog that is to be retired from service, the
3131 governmental entity that owns the dog shall transfer ownership of
3232 the dog to the peace officer.
3333 Sec. 614.224. PURCHASE OF LAW ENFORCEMENT DOG BY HONORABLY
3434 RETIRED PEACE OFFICER. On the request of a peace officer who
3535 retires honorably and who has been the handler of a law enforcement
3636 dog, a governmental entity shall allow the peace officer to
3737 purchase the dog.
3838 Sec. 614.225. PURCHASE OF LAW ENFORCEMENT DOG BY SURVIVING
3939 SPOUSE, CHILD, OR PARENT OF DECEASED PEACE OFFICER. (a) For a law
4040 enforcement dog whose handler died while commissioned, the
4141 governmental entity that owns the dog may sell the dog to, in order
4242 of priority:
4343 (1) the surviving spouse of the deceased peace
4444 officer;
4545 (2) a child of the deceased peace officer; and
4646 (3) a parent of the deceased peace officer.
4747 (b) The governmental entity may sell a dog under Subsection
4848 (a) regardless of whether the officer died while discharging the
4949 officer's official duties.
5050 Sec. 614.226. PURCHASE PRICE OF LAW ENFORCEMENT DOG. A
5151 governmental entity shall establish the amount for which a law
5252 enforcement dog may be purchased under this subchapter, which may
5353 not exceed fair market value.
5454 SECTION 2. This Act takes effect September 1, 2019.
