66 AN ACT
77 relating to workers' compensation death benefit eligibility for
88 certain spouses of first responders and certain other public
99 servants killed in the line of duty.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 408.183(b-1), Labor Code, is amended to
1212 read as follows:
1313 (b-1) Notwithstanding Subsection (b), an eligible spouse
1414 who remarried is eligible for death benefits for life if the
1515 employee was a first responder, as defined by Section 504.055, or an
1616 individual described by Section 501.001(5)(F), who suffered death
1717 in the course and scope of employment or while providing services as
1818 a volunteer. This subsection applies regardless of the date on
1919 which the death of the first responder or other individual
2020 occurred.
2121 SECTION 2. The change in law made by this Act to Section
2222 408.183(b-1), Labor Code, applies only to an eligible spouse who
2323 remarries on or after the effective date of this Act. An eligible
2424 spouse who remarried before that date is governed by the law as it
2525 existed immediately before the effective date of this Act, and the
2626 former law is continued in effect for that purpose.
2727 SECTION 3. This Act takes effect September 1, 2019.
