128 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
13- SECTION 1. Section 2269.402, Government Code, is amended to
14- read as follows:

10+ adding Subsection (b) to read as follows:
1511 Sec. 2269.402. APPLICABILITY OF SUBCHAPTER TO BUILDINGS;
16- EXCEPTIONS. This subchapter applies only to a facility that is a
17- building, the design and construction of which is governed by
12+ EXCEPTIONS. (a) This subchapter applies only to a facility that is
13+ a building, the design and construction of which is governed by
1814 accepted building codes, or a structure or land, whether improved
19- or unimproved, that is associated with a building. Except as
20- provided by Section 22.0741, Transportation Code, this [This]

29- SECTION 2. Subchapter D, Chapter 22, Transportation Code,
30- is amended by adding Section 22.0741 to read as follows:
31- Sec. 22.0741. JOB ORDER CONTRACTING BY CERTAIN JOINT
32- AIRPORT BOARDS. (a) This section applies only to a joint board:
33- (1) for which the constituent agencies are populous
34- home-rule municipalities; and
35- (2) that operates a facility that is:
36- (A) an airport roadway, bridge, runway, taxiway,
37- or related type of project associated with civil engineering
38- construction; or
39- (B) a building or structure incidental to a
40- facility described by Paragraph (A).
41- (b) Notwithstanding Section 2269.402, Government Code, a
42- joint board to which this section applies may award a job order
43- contract as provided by Subchapter I, Chapter 2269, Government
44- Code, for the maintenance, repair, alteration, renovation,
45- remediation, or minor construction of a facility described by
46- Subsection (a)(2) if the individual job, task, or purchase order
47- for the maintenance, repair, alteration, renovation, remediation,
48- or construction does not exceed $300,000.
49- SECTION 3. This Act takes effect immediately if it receives

33+ associated with civil engineering construction; and
34+ (B) for which an individual job, task or purchase
35+ order for the facility do not exceed $300,000 and are for the
36+ maintenance, repair, alteration, renovation, remediation, or
37+ minor construction of a facility described in Subsection (b)(2)(A).
38+ SECTION 2. This Act takes effect immediately if it receives
5039 a vote of two-thirds of all the members elected to each house, as
