| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Subchapter I, Chapter 201, Transportation Code, |
|---|
| 12 | 12 | | is amended by adding Section 201.711 to read as follows: |
|---|
| 13 | 13 | | Sec. 201.711. PURCHASE OF FOOD AND BEVERAGES FOR CERTAIN |
|---|
| 14 | 14 | | DEPARTMENT EMPLOYEES RESPONDING TO EMERGENCIES OR DISASTERS. The |
|---|
| 15 | 15 | | department, using appropriated funds, may purchase food and |
|---|
| 16 | 16 | | beverages for a department employee who is: |
|---|
| 17 | 17 | | (1) providing services in response to an emergency |
|---|
| 18 | 18 | | situation, an incident that endangers the health or safety of a |
|---|
| 19 | 19 | | person, or a disaster; and |
|---|
| 20 | 20 | | (2) unable to leave or required to remain at the |
|---|
| 21 | 21 | | employee's assignment area due to the emergency situation, |
|---|
| 22 | 22 | | incident, or disaster. |

| 23 | 23 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 24 | 24 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 25 | 25 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 26 | 26 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 27 | 27 | | Act takes effect September 1, 2019. |
