10 | 10 | SECTION 1. Subtitle C, Title 5, Business & Commerce Code, is | |
11 | 11 | amended by adding Chapter 113 to read as follows: | |
12 | 12 | CHAPTER 113. TRANSPORTATION BUSINESSES | |
13 | 13 | Sec. 113.0001. DEFINITION. In this chapter, "high-speed | |
14 | 14 | rail" means passenger rail service that is reasonably expected to | |
15 | 15 | reach speeds of 110 miles per hour. | |
16 | 16 | Sec. 113.0002. ENTRY ONTO PROPERTY: EXAMINATION OR SURVEY | |
17 | 17 | FOR HIGH-SPEED RAIL. A private entity, or a third party contracted | |
18 | 18 | by or on behalf of the private entity, may not enter on the lands or | |
19 | 19 | waters of any person or corporation to make an examination or | |
20 | 20 | survey, including a lineal survey, for a proposed high-speed rail | |
21 | 21 | project unless the entity has the funding necessary to complete the | |
22 | 22 | project. | |
23 | 23 | SECTION 2. This Act takes effect September 1, 2019. |
