| 5 | 12 | | relating to the authority of a governmental unit that has withdrawn |

| 6 | 13 | | from a regional planning commission to join another regional |
|---|

| 8 | 15 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 16 | | SECTION 1. Chapter 391, Local Government Code, is amended |
|---|
| 10 | 17 | | by adding Section 391.016 to read as follows: |
|---|
| 11 | 18 | | Sec. 391.016. JOINING COMMISSION AFTER WITHDRAWAL. A |
|---|
| 12 | 19 | | governmental unit that has withdrawn from a commission under |
|---|
| 13 | 20 | | Section 391.015 may join another commission that is adjacent to the |
|---|
| 14 | 21 | | unit if: |
|---|
| 15 | 22 | | (1) the transfer is approved by the governing bodies |
|---|
| 16 | 23 | | of: |
|---|
| 17 | 24 | | (A) the unit; and |
|---|
| 18 | 25 | | (B) the commission the unit wishes to join; |
|---|
| 19 | 26 | | (2) the governmental unit submits a written request |
|---|
| 20 | 27 | | for approval of the transfer to the governor that: |
|---|
| 21 | 28 | | (A) is in the form and manner prescribed by the |
|---|
| 22 | 29 | | office of the governor; and |
|---|
| 23 | 30 | | (B) demonstrates the transfer furthers the |
|---|
| 24 | 31 | | purpose of this chapter as described by Section 391.001; and |
|---|
| 25 | 32 | | (3) the governor approves the transfer. |
|---|
| 26 | 33 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 27 | 34 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 28 | 35 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 29 | 36 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 30 | 37 | | Act takes effect September 1, 2019. |
