9+ A BILL TO BE ENTITLED
410 AN ACT
511 relating to judicial guidance related to child protective services
612 cases and juvenile cases.
713 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
814 SECTION 1. Subchapter A, Chapter 22, Government Code, is
915 amended by adding Section 22.0135 to read as follows:
1016 Sec. 22.0135. JUDICIAL GUIDANCE RELATED TO CHILD PROTECTIVE
1117 SERVICES CASES AND JUVENILE CASES. (a) The supreme court, in
1218 conjunction with the Supreme Court of Texas Permanent Judicial
1319 Commission for Children, Youth and Families, annually shall provide
1420 guidance to judges who preside over child protective services cases
15- or juvenile cases to es
16- tablish greater uniformity across the state
21+ or juvenile cases to establish greater uniformity across the state
1722 for:
1823 (1) in child protective services cases, issues related
1924 to:
2025 (A) placement of children with severe mental
2126 health issues;
2227 (B) changes in placement; and
2328 (C) final termination of parental rights; and
2429 (2) in juvenile cases, issues related to:
2530 (A) placement of children with severe mental
2631 health issues;
2732 (B) the release of children detained in juvenile
2833 detention facilities;
2934 (C) certification of juveniles to stand trial as
3035 adults;
3136 (D) a child's appearance before a court in a
3237 judicial proceeding, including the use of a restraint on the child
3338 and the clothing worn by the child during the proceeding; and
3439 (E) commitment of children to the Texas Juvenile
3540 Justice Department.
3641 (b) The supreme court shall adopt the rules necessary to
3742 accomplish the purposes of this section.
3843 SECTION 2. This Act takes effect September 1, 2019.
