7 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

8 | 14 | | SECTION 1. Subchapter A, Chapter 22, Government Code, is |
---|
9 | 15 | | amended by adding Section 22.0135 to read as follows: |
---|
10 | 16 | | Sec. 22.0135. JUDICIAL GUIDANCE RELATED TO CHILD PROTECTIVE |
---|
11 | 17 | | SERVICES CASES AND JUVENILE CASES. (a) The supreme court, in |
---|
12 | 18 | | conjunction with the Supreme Court of Texas Permanent Judicial |
---|
13 | 19 | | Commission for Children, Youth and Families, annually shall provide |
---|
14 | 20 | | guidance to judges who preside over child protective services cases |
---|
17 | 22 | | for: |
---|
18 | 23 | | (1) in child protective services cases, issues related |
---|
19 | 24 | | to: |
---|
20 | 25 | | (A) placement of children with severe mental |
---|
21 | 26 | | health issues; |
---|
22 | 27 | | (B) changes in placement; and |
---|
23 | 28 | | (C) final termination of parental rights; and |
---|
24 | 29 | | (2) in juvenile cases, issues related to: |
---|
25 | 30 | | (A) placement of children with severe mental |
---|
26 | 31 | | health issues; |
---|
27 | 32 | | (B) the release of children detained in juvenile |
---|
28 | 33 | | detention facilities; |
---|
29 | 34 | | (C) certification of juveniles to stand trial as |
---|
30 | 35 | | adults; |
---|
31 | 36 | | (D) a child's appearance before a court in a |
---|
32 | 37 | | judicial proceeding, including the use of a restraint on the child |
---|
33 | 38 | | and the clothing worn by the child during the proceeding; and |
---|
34 | 39 | | (E) commitment of children to the Texas Juvenile |
---|
35 | 40 | | Justice Department. |
---|
36 | 41 | | (b) The supreme court shall adopt the rules necessary to |
---|
37 | 42 | | accomplish the purposes of this section. |
---|
38 | 43 | | SECTION 2. This Act takes effect September 1, 2019. |
