66 AN ACT
77 relating to the disciplinary authority of the Texas Medical Board
88 regarding complaints concerning health care professionals licensed
99 by other agencies.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter B, Chapter 154, Occupations Code, is
1212 amended by adding Section 154.059 to read as follows:
1313 Sec. 154.059. COMPLAINT CONCERNING PROFESSIONAL LICENSED
1414 UNDER OTHER LAW. Notwithstanding any other law:
1515 (1) on receipt of a complaint regarding a person who is
1616 licensed, registered, or otherwise authorized to practice a
1717 profession under this title, other than a physician or other person
1818 licensed by the board, the board shall promptly forward a copy of
1919 the complaint to the appropriate licensing agency; and
2020 (2) the board may not take disciplinary action against
2121 the person based on the complaint if the appropriate licensing
2222 agency, after an investigation, takes disciplinary action against
2323 the person or dismisses the complaint without taking disciplinary
2424 action.
2525 SECTION 2. The change in law made by this Act applies only
2626 to a complaint filed on or after the effective date of this Act. A
2727 complaint filed before the effective date of this Act is governed by
2828 the law in effect on the date the complaint was filed, and the
2929 former law is continued in effect for that purpose.
3030 SECTION 3. This Act takes effect September 1, 2019.
