8 | 8 | | regarding complaints concerning health care professionals licensed |

10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 11 | | SECTION 1. Subchapter B, Chapter 154, Occupations Code, is |
---|
12 | 12 | | amended by adding Section 154.059 to read as follows: |
---|
13 | 13 | | Sec. 154.059. COMPLAINT CONCERNING PROFESSIONAL LICENSED |
---|
14 | 14 | | UNDER OTHER LAW. Notwithstanding any other law: |
---|
15 | 15 | | (1) on receipt of a complaint regarding a person who is |
---|
16 | 16 | | licensed, registered, or otherwise authorized to practice a |
---|
17 | 17 | | profession under this title, other than a physician or other person |
---|
18 | 18 | | licensed by the board, the board shall promptly forward a copy of |
---|
19 | 19 | | the complaint to the appropriate licensing agency; and |
---|
20 | 20 | | (2) the board may not take disciplinary action against |
---|
21 | 21 | | the person based on the complaint if the appropriate licensing |
---|
22 | 22 | | agency, after an investigation, takes disciplinary action against |
---|
23 | 23 | | the person or dismisses the complaint without taking disciplinary |
---|
24 | 24 | | action. |
---|
25 | 25 | | SECTION 2. The change in law made by this Act applies only |
---|
26 | 26 | | to a complaint filed on or after the effective date of this Act. A |
---|
27 | 27 | | complaint filed before the effective date of this Act is governed by |
---|
28 | 28 | | the law in effect on the date the complaint was filed, and the |
---|
29 | 29 | | former law is continued in effect for that purpose. |
---|
30 | 30 | | SECTION 3. This Act takes effect September 1, 2019. |
