55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the procedure by which certain voters receive ballots
88 to be voted by mail for each election held during a certain period.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. The heading to Section 86.0015, Election Code,
1111 is amended to read as follows:
1212 Sec. 86.0015. [ANNUAL] BALLOTS BY MAIL FOR MULTIPLE
1313 ELECTIONS FOLLOWING SINGLE APPLICATION.
1414 SECTION 2. Section 86.0015, Election Code, is amended by
1515 amending Subsection (b) and adding Subsection (g) to read as
1616 follows:
1717 (b) An application described by Subsection (a) is
1818 considered to be an application for a ballot for each election,
1919 including any ensuing runoff:
2020 (1) in which the applicant is eligible to vote; and
2121 (2) that occurs before the earlier of:
2222 (A) [except as provided by Subsection (b-2),] the
2323 end of the next calendar year following the calendar year in which
2424 the application was submitted;
2525 (B) the date the county clerk receives notice
2626 from the voter registrar under Subsection (f) that the voter has
2727 changed residence to another county; or
2828 (C) the date the voter's registration is
2929 canceled.
3030 (g) The county clerk shall provide to a voter who has
3131 applied for and qualifies to receive ballots to be voted by mail
3232 under this section, before the end of the last calendar year for
3333 which the voter will receive ballots under this section, a notice
3434 stating that the voter must make a new application under this
3535 section if the voter wishes to continue to receive ballots to be
3636 voted by mail.
3737 SECTION 3. Section 86.0015(b-2), Election Code, is
3838 repealed.
3939 SECTION 4. The change in law made by this Act to Section
4040 86.0015, Election Code, applies only to an application for a ballot
4141 to be voted by mail submitted on or after the effective date of this
4242 Act. An application for a ballot to be voted by mail submitted
4343 before the effective date of this Act is governed by the law in
4444 effect when the application was submitted, and the former law is
4545 continued in effect for that purpose.
4646 SECTION 5. This Act takes effect September 1, 2019.
