97 relating to the issuance of an occupational driver's license.
108 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
119 SECTION 1. Section 521.242, Transportation Code, is amended
1210 by adding Subsections (b-1), (g), and (h) and amending Subsection
1311 (d) to read as follows:
1412 (b-1) A person whose driver's license is suspended under
1513 Chapter 708 or denied renewal under Chapter 706 may apply for an
1614 occupational license by filing a verified petition with the clerk
17- of a court:
18- (1) in which the person was convicted for an
19- underlying offense giving rise to the license suspension or denial;
20- or
21- (2) with whose order to pay or satisfy a judgment
22- ordering payment of a fine and cost the person failed to comply,
23- giving rise to the license denial.

2417 (d) A petition filed under Subsection (b) or (b-1) must
25- state that the petitioner was:
26- (1) convicted in that court for an offense under the
27- laws of this state; or
28- (2) ordered by that court to pay or satisfy a judgment
29- ordering payment of a fine or cost.

3020 (g) A court shall notify a person at sentencing that the
3121 person may be entitled to an occupational license if:
3222 (1) the person's driver's license is automatically
3323 suspended following the conviction;
3424 (2) the person's driver's license is suspended for
3525 failure to pay surcharges associated with the conviction under
3626 Chapter 708; or
3727 (3) the person's driver's license is denied renewal
3828 under Chapter 706 for failure to pay or satisfy a judgment ordering
3929 the payment of a fine and cost in the manner ordered by the court.
4030 (h) Each justice and municipal court shall provide a
4131 standard petition form that a person may complete and file with the
4232 clerk to apply for an occupational license. The form must include
4333 instructions for obtaining a waiver of the application fee for
4434 persons who are unable to pay.
4535 SECTION 2. This Act takes effect September 1, 2019.
