95 AN ACT
10- relating to the authorization by referendum on an optional county
11- fee on vehicle registration in certain counties.
6+ relating to authorizing an increase in an optional county fee on
7+ vehicle registration in certain counties.
128 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
13- SECTION 1. Subchapter H, Chapter 502, Transportation Code,
14- is amended by adding Section 502.4021 to read as follows:
15- Sec. 502.4021. OPTIONAL COUNTY FEE FOR REGIONAL MOBILITY
16- AUTHORITY TRANSPORTATION PROJECTS APPROVED BY METROPOLITAN
17- PLANNING ORGANIZATION. (a) This section applies only to a county
18- that borders the United Mexican States and has a population of more
19- than 800,000.
20- (b) The commissioners court of a county by order may impose,
21- in addition to any fee imposed under Section 502.402 or another
22- provision of this chapter in the county, a fee of not more than $10
23- for a vehicle registered in the county if approved by a majority of
24- the qualified voters of the county voting at an election, which the
25- commissioners court may order and hold for that purpose.
26- (c) A vehicle that may be registered under this chapter
27- without payment of a registration fee may be registered under this
28- section without payment of the additional fee.
29- (d) A fee imposed under this section may take effect and be
30- removed in accordance with the requirements of Section 502.401.
9+ SECTION 1. Sections 502.402(b-1) and (e), Transportation
10+ Code, are amended to read as follows:
11+ (b-1) The commissioners court of a county described by
12+ Subsection (a)(1) [(a)] with a population of less than 700,000 or
13+ more than 800,000 may increase the additional fee to an amount that
14+ does not exceed $20 if approved by a majority of the qualified
15+ voters of the county voting on the issue at a referendum election,
16+ which the commissioners court may order and hold for that purpose.
3117 (e) The additional fee shall be collected for a vehicle when
32- other fees imposed under this chapter are collected.
33- (f) The fee revenue collected shall be sent to a regional
34- mobility authority located in the county to fund long-term
35- transportation projects in the county that are:
36- (1) consistent with the purposes specified by Section
37- 7-a, Article VIII, Texas Constitution; and
38- (2) included in a plan approved by the metropolitan
39- planning organization that serves the county.
40- (g) The department shall adopt rules necessary to
41- administer registration for a vehicle being registered in a county
42- imposing a fee under this section.
18+ other fees imposed under this chapter are collected. The fee
19+ revenue collected shall be sent to a regional mobility authority
20+ located in the county or, if the county has a population of more
21+ than 800,000, to the metropolitan planning organization that serves
22+ the county. The fee revenue may be used only to fund long-
23+ term
24+ transportation projects in the county that are consistent with the
25+ purposes specified by Section 7-a, Article VIII, Texas
26+ Constitution.
4327 SECTION 2. This Act takes effect immediately if it receives
4428 a vote of two-thirds of all the members elected to each house, as
4529 provided by Section 39, Article III, Texas Constitution. If this
4630 Act does not receive the vote necessary for immediate effect, this
4731 Act takes effect September 1, 2019.
