7 | 7 | relating to the provision of behavioral health services for certain | |
8 | 8 | persons under the medical assistance program. | |
9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Section 32.024, Human Resources Code, is amended | |
11 | 11 | by adding Subsection (ll) to read as follows: | |
12 | 12 | (ll) In this subsection, "serious mental illness" has the | |
13 | 13 | meaning assigned by Section 1355.001, Insurance Code. The | |
14 | 14 | commission in its rules and standards governing the scope of | |
15 | 15 | services provided under the medical assistance program shall | |
16 | 16 | include behavioral health services for a person who: | |
17 | 17 | (1) is at least 20 years of age but younger than 65 | |
18 | 18 | years of age; | |
19 | 19 | (2) has been diagnosed with a serious mental illness; | |
20 | 20 | and | |
21 | 21 | (3) has been arrested at least once. | |
22 | 22 | SECTION 2. If before implementing any provision of this Act | |
23 | 23 | a state agency determines that a waiver or authorization from a | |
24 | 24 | federal agency is necessary for implementation of that provision, | |
25 | 25 | the agency affected by the provision shall request the waiver or | |
26 | 26 | authorization and may delay implementing that provision until the | |
27 | 27 | waiver or authorization is granted. | |
28 | 28 | SECTION 3. This Act takes effect September 1, 2019. |
