55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the provision of behavioral health services for certain
88 persons under the medical assistance program.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 32.024, Human Resources Code, is amended
1111 by adding Subsection (ll) to read as follows:
1212 (ll) In this subsection, "serious mental illness" has the
1313 meaning assigned by Section 1355.001, Insurance Code. The
1414 commission in its rules and standards governing the scope of
1515 services provided under the medical assistance program shall
1616 include behavioral health services for a person who:
1717 (1) is at least 20 years of age but younger than 65
1818 years of age;
1919 (2) has been diagnosed with a serious mental illness;
2020 and
2121 (3) has been arrested at least once.
2222 SECTION 2. If before implementing any provision of this Act
2323 a state agency determines that a waiver or authorization from a
2424 federal agency is necessary for implementation of that provision,
2525 the agency affected by the provision shall request the waiver or
2626 authorization and may delay implementing that provision until the
2727 waiver or authorization is granted.
2828 SECTION 3. This Act takes effect September 1, 2019.
