55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to requiring an open-enrollment charter school to prepare
88 an informed choice report containing certain information about the
99 school.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter D, Chapter 12, Education Code, is
1212 amended by adding Section 12.138 to read as follows:
1313 Sec. 12.138. INFORMED CHOICE REPORT. (a) Not later than
1414 December 1 of each year, an open-enrollment charter school shall
1515 prepare and submit to the agency an informed choice report in the
1616 format and manner provided by the agency. The informed choice
1717 report must include the following information:
1818 (1) the information contained in the most recent
1919 campus report card for each campus of the school under Section
2020 39.305;
2121 (2) student demographics, including the percentage of
2222 students eligible for and enrolled in programs for which the school
2323 receives an allotment under Section 42.151, 42.152, 42.153, 42.154,
2424 or 42.156;
2525 (3) the school year calendar for the current school
2626 year and the next school year, if known;
2727 (4) information regarding transportation and meals
2828 provided to students by the school, including if the school
2929 participates in the national free or reduced-price lunch program
3030 established under 42 U.S.C. Section 1751 et seq.;
3131 (5) for each high school campus of the school, the
3232 availability of:
3333 (A) courses that are part of an endorsement
3434 curriculum under Section 28.025(c-1); and
3535 (B) dual credit courses under Section 28.009;
3636 (6) extracurricular activities offered, including
3737 music, arts, and sports;
3838 (7) the number of courses in enrichment curriculum
3939 subjects offered, including fine arts;
4040 (8) for each elementary school campus of the school,
4141 the availability of opportunities for students in a grade level
4242 below grade six to participate in moderate or vigorous daily
4343 physical activity for at least 30 minutes;
4444 (9) a list of parental rights and responsibilities the
4545 school provides or elects not to provide under Chapter 26,
4646 including access to student records and review of teaching
4747 materials and assessments;
4848 (10) any parental requirements to participate or
4949 volunteer at the school or for school programs, including an
5050 estimate of the time commitment required;
5151 (11) teacher information, including:
5252 (A) the percentage of teachers who are
5353 uncertified or assigned to teach courses outside the teacher's area
5454 of certification;
5555 (B) average years of experience;
5656 (C) the annual attrition rate; and
5757 (D) average salary;
5858 (12) the number of spots available for new students at
5959 each grade level;
6060 (13) the number of applicants for admission for each
6161 grade level who are on a waiting list;
6262 (14) information regarding admission criteria,
6363 including the application for admission and disciplinary history
6464 considerations that could exclude an applicant from admission to
6565 the school;
6666 (15) information regarding specific criteria,
6767 policies, and procedures for discipline or expulsion included in
6868 the school's code of conduct that differ from the requirements for
6969 school districts in Chapter 37;
7070 (16) rates of student suspension, expulsion, and
7171 attrition;
7272 (17) any additional requirements for student
7373 graduation that exceed the graduation requirements for a student
7474 enrolled at a school district;
7575 (18) a list of courses, materials, and assessments
7676 that use common core state standards, as defined by Section
7777 28.002(b-1);
7878 (19) if the school is not required to comply with
7979 Subchapter D, Chapter 32, information regarding how the school
8080 protects covered information, as defined by Section 32.151;
8181 (20) if the school provides a full-time online program
8282 through the state virtual school network, information regarding:
8383 (A) the entity that provides the program;
8484 (B) course completion rates;
8585 (C) course attrition rates;
8686 (D) aggregate student performance on assessment
8787 instruments administered under Section 39.023 for the previous five
8888 years; and
8989 (E) if the entity previously provided an online
9090 program for a school district or open-enrollment charter school,
9191 aggregate student performance on assessment instruments
9292 administered under Section 39.023 for the last five years during
9393 which the entity provided the program;
9494 (21) if students have access to a school library;
9595 (22) the number of school counselors and nurses
9696 available at each campus of the school; and
9797 (23) whether the school's performance is measured
9898 using an alternative accountability system.
9999 (b) Not later than January 1 of each year, the agency shall
100100 post each open-enrollment charter school's informed choice report
101101 on the agency's Internet website. An open-enrollment charter
102102 school shall post on the school's admission information web page of
103103 the school's Internet website:
104104 (1) the school's informed choice report; or
105105 (2) a link to the school's informed choice report on
106106 the agency's website.
107107 SECTION 2. This Act takes effect September 1, 2019.
