7 | 7 | | relating to requiring an open-enrollment charter school to prepare |
---|
8 | 8 | | an informed choice report containing certain information about the |
---|
9 | 9 | | school. |
---|
10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
---|
11 | 11 | | SECTION 1. Subchapter D, Chapter 12, Education Code, is |
---|
12 | 12 | | amended by adding Section 12.138 to read as follows: |
---|
13 | 13 | | Sec. 12.138. INFORMED CHOICE REPORT. (a) Not later than |
---|
14 | 14 | | December 1 of each year, an open-enrollment charter school shall |
---|
15 | 15 | | prepare and submit to the agency an informed choice report in the |
---|
16 | 16 | | format and manner provided by the agency. The informed choice |
---|
17 | 17 | | report must include the following information: |
---|
18 | 18 | | (1) the information contained in the most recent |
---|
19 | 19 | | campus report card for each campus of the school under Section |
---|
20 | 20 | | 39.305; |
---|
21 | 21 | | (2) student demographics, including the percentage of |
---|
22 | 22 | | students eligible for and enrolled in programs for which the school |
---|
23 | 23 | | receives an allotment under Section 42.151, 42.152, 42.153, 42.154, |
---|
24 | 24 | | or 42.156; |
---|
25 | 25 | | (3) the school year calendar for the current school |
---|
26 | 26 | | year and the next school year, if known; |
---|
27 | 27 | | (4) information regarding transportation and meals |
---|
28 | 28 | | provided to students by the school, including if the school |
---|
29 | 29 | | participates in the national free or reduced-price lunch program |
---|
30 | 30 | | established under 42 U.S.C. Section 1751 et seq.; |
---|
31 | 31 | | (5) for each high school campus of the school, the |
---|
32 | 32 | | availability of: |
---|
33 | 33 | | (A) courses that are part of an endorsement |
---|
34 | 34 | | curriculum under Section 28.025(c-1); and |
---|
35 | 35 | | (B) dual credit courses under Section 28.009; |
---|
36 | 36 | | (6) extracurricular activities offered, including |
---|
37 | 37 | | music, arts, and sports; |
---|
38 | 38 | | (7) the number of courses in enrichment curriculum |
---|
39 | 39 | | subjects offered, including fine arts; |
---|
40 | 40 | | (8) for each elementary school campus of the school, |
---|
41 | 41 | | the availability of opportunities for students in a grade level |
---|
42 | 42 | | below grade six to participate in moderate or vigorous daily |
---|
43 | 43 | | physical activity for at least 30 minutes; |
---|
44 | 44 | | (9) a list of parental rights and responsibilities the |
---|
45 | 45 | | school provides or elects not to provide under Chapter 26, |
---|
46 | 46 | | including access to student records and review of teaching |
---|
47 | 47 | | materials and assessments; |
---|
48 | 48 | | (10) any parental requirements to participate or |
---|
49 | 49 | | volunteer at the school or for school programs, including an |
---|
50 | 50 | | estimate of the time commitment required; |
---|
51 | 51 | | (11) teacher information, including: |
---|
52 | 52 | | (A) the percentage of teachers who are |
---|
53 | 53 | | uncertified or assigned to teach courses outside the teacher's area |
---|
54 | 54 | | of certification; |
---|
55 | 55 | | (B) average years of experience; |
---|
56 | 56 | | (C) the annual attrition rate; and |
---|
57 | 57 | | (D) average salary; |
---|
58 | 58 | | (12) the number of spots available for new students at |
---|
59 | 59 | | each grade level; |
---|
60 | 60 | | (13) the number of applicants for admission for each |
---|
61 | 61 | | grade level who are on a waiting list; |
---|
62 | 62 | | (14) information regarding admission criteria, |
---|
63 | 63 | | including the application for admission and disciplinary history |
---|
64 | 64 | | considerations that could exclude an applicant from admission to |
---|
65 | 65 | | the school; |
---|
66 | 66 | | (15) information regarding specific criteria, |
---|
67 | 67 | | policies, and procedures for discipline or expulsion included in |
---|
68 | 68 | | the school's code of conduct that differ from the requirements for |
---|
69 | 69 | | school districts in Chapter 37; |
---|
70 | 70 | | (16) rates of student suspension, expulsion, and |
---|
71 | 71 | | attrition; |
---|
72 | 72 | | (17) any additional requirements for student |
---|
73 | 73 | | graduation that exceed the graduation requirements for a student |
---|
74 | 74 | | enrolled at a school district; |
---|
75 | 75 | | (18) a list of courses, materials, and assessments |
---|
76 | 76 | | that use common core state standards, as defined by Section |
---|
77 | 77 | | 28.002(b-1); |
---|
78 | 78 | | (19) if the school is not required to comply with |
---|
79 | 79 | | Subchapter D, Chapter 32, information regarding how the school |
---|
80 | 80 | | protects covered information, as defined by Section 32.151; |
---|
81 | 81 | | (20) if the school provides a full-time online program |
---|
82 | 82 | | through the state virtual school network, information regarding: |
---|
83 | 83 | | (A) the entity that provides the program; |
---|
84 | 84 | | (B) course completion rates; |
---|
85 | 85 | | (C) course attrition rates; |
---|
86 | 86 | | (D) aggregate student performance on assessment |
---|
87 | 87 | | instruments administered under Section 39.023 for the previous five |
---|
88 | 88 | | years; and |
---|
89 | 89 | | (E) if the entity previously provided an online |
---|
90 | 90 | | program for a school district or open-enrollment charter school, |
---|
91 | 91 | | aggregate student performance on assessment instruments |
---|
92 | 92 | | administered under Section 39.023 for the last five years during |
---|
93 | 93 | | which the entity provided the program; |
---|
94 | 94 | | (21) if students have access to a school library; |
---|
95 | 95 | | (22) the number of school counselors and nurses |
---|
96 | 96 | | available at each campus of the school; and |
---|
97 | 97 | | (23) whether the school's performance is measured |
---|
98 | 98 | | using an alternative accountability system. |
---|
99 | 99 | | (b) Not later than January 1 of each year, the agency shall |
---|
100 | 100 | | post each open-enrollment charter school's informed choice report |
---|
101 | 101 | | on the agency's Internet website. An open-enrollment charter |
---|
102 | 102 | | school shall post on the school's admission information web page of |
---|
103 | 103 | | the school's Internet website: |
---|
104 | 104 | | (1) the school's informed choice report; or |
---|
105 | 105 | | (2) a link to the school's informed choice report on |
---|
106 | 106 | | the agency's website. |
---|
107 | 107 | | SECTION 2. This Act takes effect September 1, 2019. |
---|
