410 AN ACT
511 relating to the establishment of the Pediatric Acute-Onset
612 Neuropsychiatric Syndrome Advisory Council.
713 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
814 SECTION 1. Subtitle E, Title 2, Health and Safety Code, is
915 amended by adding Chapter 119A to read as follows:
1016 CHAPTER 119A. PEDIATRIC ACUTE-ONSET NEUROPSYCHIATRIC SYNDROME
1117 ADVISORY COUNCIL
1218 Sec. 119A.001. DEFINITION. In this chapter, "advisory
1319 council" means the Pediatric Acute-Onset Neuropsychiatric Syndrome
1420 Advisory Council established under this chapter.
1521 Sec. 119A.002. ESTABLISHMENT OF ADVISORY COUNCIL. The
1622 Pediatric Acute-Onset Neuropsychiatric Syndrome Advisory Council
1723 is established to advise the commission and the legislature on
1824 research, diagnosis, treatment, and education related to pediatric
1925 acute-onset neuropsychiatric syndrome.
2026 Sec. 119A.003. APPOINTMENT OF ADVISORY COUNCIL MEMBERS.
2127 (a) The advisory council is composed of the following 19 members:
2228 (1) one member designated by the executive
2329 commissioner;
2430 (2) two members of the senate appointed by the
2531 lieutenant governor;
2632 (3) two members of the house of representatives
2733 appointed by the speaker of the house of representatives; and
2834 (4) 14 members appointed by the governor with the
2935 following qualifications:
3036 (A) one member who is a licensed health care
3137 provider with expertise in treating persons with pediatric
3238 acute-onset neuropsychiatric syndrome, including pediatric
3339 autoimmune neuropsychiatric disorders associated with
3440 streptococcal infections, and autism;
3541 (B) one member who is an osteopathic physician
3642 with experience treating persons with pediatric acute-onset
3743 neuropsychiatric syndrome, including pediatric autoimmune
3844 neuropsychiatric disorders associated with streptococcal
3945 infections;
4046 (C) one member who is a pediatrician with
4147 experience treating persons with pediatric acute-onset
4248 neuropsychiatric syndrome, including pediatric autoimmune
4349 neuropsychiatric disorders associated with streptococcal
4450 infections;
4551 (D) one member who is a child psychiatrist with
4652 experience treating persons with pediatric acute-onset
4753 neuropsychiatric syndrome, including pediatric autoimmune
4854 neuropsychiatric disorders associated with streptococcal
4955 infections;
5056 (E) one member who is an immunologist with
5157 experience treating persons with pediatric acute-onset
5258 neuropsychiatric syndrome, including pediatric autoimmune
5359 neuropsychiatric disorders associated with streptococcal
5460 infections, and the use of intravenous immunoglobulin;
5561 (F) one member who is a dietician or nutritionist
5662 who provides services to children with autism spectrum disorders,
5763 attention-deficit/hyperactivity disorders, and other
5864 neuro-developmental conditions;
5965 (G) one member with experience in conducting
6066 research on pediatric acute-onset neuropsychiatric syndrome,
6167 including pediatric autoimmune neuropsychiatric disorders
6268 associated with streptococcal infections, obsessive-compulsive
6369 disorder, tic disorders, and other neurological disorders;
6470 (H) one member who is licensed by this state to
6571 practice as a social worker;
6672 (I) one member who is a representative of the
6773 Texas Education Agency with expertise in special education
6874 services;
6975 (J) one member who is a psychologist licensed
7076 under Chapter 501, Occupations Code;
7177 (K) one member who is a representative of a
7278 professional organization in this state for school nurses;
7379 (L) one member who is a representative of an
7480 advocacy and support group in this state for individuals affected
7581 by pediatric acute-onset neuropsychiatric syndrome, including
7682 pediatric autoimmune neuropsychiatric disorders associated with
7783 streptococcal infections;
7884 (M) one member who is a representative of an
7985 advocacy and support group in this state for individuals affected
8086 by autism; and
8187 (N) one member who is a parent of a child who has
8288 been diagnosed with pediatric acute-onset neuropsychiatric
8389 syndrome or autism.
8490 (b) The member designated by the executive commissioner
8591 serves as an ex officio nonvoting member. In the event of a tie vote
8692 among the members of the advisory council, the member designated by
8793 the executive commissioner may cast the deciding vote.
8894 (c) Each member of the advisory council must be a citizen of
8995 this state.
9096 Sec. 119A.004. TERMS; VACANCY. (a) Advisory council
9197 members appointed by the lieutenant governor and the speaker of the
9298 house of representatives serve terms that coincide with the
9399 advisory council members' terms of office. The remaining members
94100 serve two-year terms.
95101 (b) A vacancy on the advisory council shall be filled in the
96102 same manner as the original appointment.
97103 (c) A member appointed to fill a vacancy holds the office
98104 for the unexpired portion of the term.
99105 (d) Each member may be reappointed to serve on the advisory
100106 council.
101107 Sec. 119A.005. CHAIR AND VICE CHAIR. Members of the
102108 advisory council shall elect from among the legislative members of
103109 the advisory council a chair and vice chair.
104110 Sec. 119A.006. MEETINGS; QUORUM. (a) The advisory council
105111 shall meet at times and locations as determined by the chair or a
106112 majority of the members of the advisory council.
107113 (b) A majority of the members of the advisory council
108114 constitute a quorum.
109115 Sec. 119A.007. ANNUAL REPORT. (a) Not later than September
110116 1 of each year, the advisory council shall prepare and submit to the
111117 governor, legislature, and commission a written report that
112118 includes recommendations on:
113119 (1) practice guidelines for the diagnosis and
114120 treatment of pediatric acute-onset neuropsychiatric syndrome,
115121 including pediatric autoimmune neuropsychiatric disorders
116122 associated with streptococcal infections;
117123 (2) mechanisms to increase clinical awareness and
118124 education regarding pediatric acute-onset neuropsychiatric
119125 syndrome, including pediatric autoimmune neuropsychiatric
120126 disorders associated with streptococcal infections, among
121127 physicians, including pediatricians, school-based health centers,
122128 and mental health care providers;
123129 (3) strategies for outreach to educators and parents
124130 to increase awareness of pediatric acute-onset neuropsychiatric
125131 syndrome, including pediatric autoimmune neuropsychiatric
126132 disorders associated with streptococcal infections; and
127133 (4) developing a network of volunteer experts on the
128134 diagnosis and treatment of pediatric acute-onset neuropsychiatric
129135 syndrome, including pediatric autoimmune neuropsychiatric
130136 disorders associated with streptococcal infections, to assist in
131137 the delivery of education and outreach.
132138 (b) Notwithstanding any other law, this section, including
133139 any action taken under this section to develop or disseminate
134140 information or materials, does not create a civil or administrative
135141 cause of action or a civil or criminal liability and does not create
136142 a standard of care, obligation, or duty that provides the basis for
137143 a cause of action.
138144 Sec. 119A.008. COMPENSATION AND REIMBURSEMENT. A member of
139145 the advisory council is not entitled to compensation or
140146 reimbursement for expenses incurred in performing advisory council
141147 duties.
142148 Sec. 119A.009. SUNSET PROVISION. The Pediatric Acute-Onset
143149 Neuropsychiatric Syndrome Advisory Council is subject to Chapter
144150 325, Government Code (Texas Sunset Act). Unless continued in
145151 existence as provided by that chapter, the advisory council is
146152 abolished and this chapter expires September 1, 2031.
147153 Sec. 119A.010. APPLICABILITY OF OTHER LAW. Chapter 2110,
148154 Government Code, does not apply to the advisory council.
149155 SECTION 2. Not later than December 31, 2019, the governor,
150156 lieutenant governor, speaker of the house of representatives, and
151157 executive commissioner of the Health and Human Services Commission
152158 shall appoint the members to the Pediatric Acute-Onset
153159 Neuropsychiatric Syndrome Advisory Council as required by Section
154160 119A.003, Health and Safety Code, as added by this Act.
155161 SECTION 3. This Act takes effect September 1, 2019.
